The Issue
This petition stems from a deeply personal experience. Robert Maloney was subjected to an unfair trial where the judge, prosecutor, and defense lawyers seemingly conspired to convict without due process. The trial was a mockery of the justice system; his judge appeared to fall asleep more than once during his trial, the jury was lied to and told he was eligible for an enhanced sentence, his defense lawyer was seen huddling and laughing with the prosecutor....the list of injustices goes on and on. When sentenced, he was incorrectly assigned to more points than is correct and sent to a maximum security prison more than a thousand miles away from his family, in a facility that is on constant lockdown, preventing him from working on his own case as his lawyer has only contacted him once in the past 15 months. This is not an isolated incident; it's part of a larger systemic issue that undermines the very foundations of our justice system.
The National Registry of Exonerations reported 139 exonerations in 2017 for crimes that people did not commit - this is evidence enough that miscarriages of justice occur more frequently than we'd like to admit (National Registry of Exonerations, 2018). Furthermore, research conducted by the Innocence Project found that prosecutorial misconduct played a role in approximately 36% of wrongful conviction cases (Innocence Project, n.d.).
We are calling on federal authorities to conduct fair reviews of criminal cases and to hold the BOP accountable for fair and humane treatment of those under their care. Every individual deserves their constitutional right to due process and fair representation. It's time for us to stand up against these injustices and demand change.
