The issue
On the 20th of October 2023 I was caught in a tragic car accident. Not only was I severely injured but my son was killed. I was 34 weeks pregnant.
Unfortunately, the law in Victoria doesn't recognise him as a human being because he did not take a breath when the doctors proceeded to an emergency C-Section.
He was my first baby. He was loved by so many people already. Not only by his family but also by friends and many others.
The morning of the accident I went to a midwife appointment. We heard his little heart beat and I've been told he was really healthy and would probably come a little early. He did.. but not the way we were expecting..
My little baby will never be recognize as a victim by the justice system and the person responsible of the accident will never be held accountable for his death.
We don't understand..
He has a birth and death certificate, his own TAC claim number. Why isn't that enough to recognise him as human being ?
The law in Victoria in regard of abortion says :
"A woman or pregnant person can access abortion up to a gestational limit of 24 weeks. Beyond the 24 weeks, a medical practitioner can provide an abortion if another medical practitioner agrees that an abortion is appropriate in all the circumstances."
I was 34 weeks.. If I can't get an abortion, why is my baby still recognise as a foetus and not a baby ?
My husband and I know that it is too late for us. Remi will never get justice.
Our battle now is to make sure this never happens to anyone else.
In order to help other family going through a similar situation, we need to make sure the law changes.

In our eyes, if the limit is 24 weeks of gestation for an abortion, any baby past 24 weeks of gestation, any baby with a birth certificate, should be recognise as human being by the law.
The law already exist in NSW under the name of Zoe's law. Let's see if we can get Remi's law to pass in Victoria to help other families in time of need.
