We Demand Justice from the Government and QBCC for Porter Davis Victims in QLD and VIC

The issue

We, the undersigned, demand justice for the victims of Porter Davis Liquidation in Queensland (QLD) and Victoria (VIC). Porter Davis is a renowned construction company that has left a trail of disappointed and aggrieved customers in the wake of its liquidation on March 31/3/2023. Many families and individuals have faced significant financial and emotional hardships due to the lack of accountability by Porter Davis and lack of government regulations to monitor fraudulent activities by builders.

Despite repeated attempts to seek help and answers from the QLD Premier, QBCC, and liquidators (Grant Thornton) the affected homeowners have been met with absolutely NO response and support. The QBCC, which is responsible for regulating the building and construction industry in QLD, has failed to adequately address the situation and hold Porter Davis accountable for their actions. 

The liquidation of Porter Davis has resulted in incomplete homes, lost deposits, and a significant breach of trust. Homeowners have been left with unfinished constructions, defects, and financial burdens, with little recourse to recover their losses.

We demand the following:

- Urgent action by the QLD Premier and QBCC to investigate the liquidation of Porter Davis and hold the company's directors and officers accountable for their fraudulent actions and immediately take actions to cancel their builders license. What a shame for QBCC to still show a builder under liquidation as "ACTIVE"

-Liquidators to stop holding home owners as "HOSTAGES" and take action to release documents and certifications of home owners to continue their build.

-TERMINATE Porter Davis license.

-Modify laws which give authority to the liquidators to chase customers to collect monies for unpaid invoices but allows liquidators to walk away "FREELY" with customers deposits.

- Immediate assistance and support for homeowners affected by Porter Davis' liquidation, including the provision of alternative options and resources for completing their homes or seeking compensation. Expedite QBCC process and modify policy to offer payouts to victims without further delays. Current wait time is several months which drains the last bit of hope out of customers.

-Freeze Englehart Homes assets to prevent the transfer of victims' deposits and creditors' funds to the subsidiary company and use this money to refund deposits to the victims.

- Review and strengthen of regulations and licensing requirements for construction companies in QLD to prevent similar incidents from occurring in the future, and to ensure better protection for homeowners.

-Modify HIA payment schedule to protect home owners from overpaying builders and modify HIA contract terms to protect customers rights and not just builders.

- Improved communication and responsiveness from the QBCC in addressing complaints and concerns raised by homeowners, and taking prompt and appropriate action against builders who fail to meet their obligations.

- Transparency in the handling of Porter Davis' liquidation, including regular updates to affected homeowners and full disclosure of the company's financial status.

- It is unacceptable that homeowners who trusted Porter Davis with their homes and investments are left in distress due to the company's liquidation, and the lack of response from the QLD Premier and QBCC. We urge the QLD government to take immediate action to hold Porter Davis accountable and provide support to the affected homeowners.
