We are coming up on the one year anniversary of Patrick Hay's tragic death at the hands of Greg Kyle DeBoer on September 25.
A lot has happened with this case, and we need you to help us make sure that ONE THING in particular DOES NOT HAPPEN! We cannot allow the Wasatch County Attorneys Scott Sweat and McKay King to enter a plea agreement with DeBoer that includes JEOPARDY! We are getting ready for opening arguments on October 1 and know that they may be considering offering jeopardy, which means that, if accepted, we can NOT go after DeBoer for murder, even though he has admitted to killing Patrick.
The Prosecuting Attorney, McKay King, as already allowed the judge to take away DeBoer's ankle bracelet ("it hurts and is expensive") and has removed our family's protection orders, and DeBoer still has a right to carry weapons in his car (including an AR-15 style rifle.) Now, King is asking the judge to not allow our family to be Victim's Representatives, stating that "the only victim in this case is the State of Utah." That is a horribly unsympathetic and disrespectful thing to say, especially when we know that our entire community feels like victims!
PLEASE write an email to Wasatch County Attorneys Scott Sweat and McKay King (both at attorney@wasatch.utah.gov or scroll down to Decision Makers) and Judge Jennifer Mabey (heberinfo@utcourts.gov) demanding that a plea agreement with jeopardy is not offered!

Imagine being stalked by another driver in a Jeep Gladiator on your way home late at night. You don’t want to lead him to your house, so you pull off on a side street. When you get out of your car to confront the driver, he tries to run you down twice, causing you to fall into the brush on the side of the road. When you get up, you find yourself on the passenger side of the Gladiator and see the window being rolled down to reveal a Colt 45 Kimber 1911 aiming right at you. Bang.
Patrick Hayes’ life was tragically cut short when he was shot by Greg Kyle DeBoer. Patrick was a vibrant individual with a larger-than-life personality and beaming smile, known for his kindness and willingness to assist anyone in need. He was an essential part of our community, as a swimming and water polo coach and mentor. It was a shock when Patrick's life was tragically and needlessly taken away, turning our peaceful neighborhood into a place where we no longer feel safe.
There is a strong belief in our community that Greg Kyle DeBoer has not been held fully accountable for his actions. Despite a preponderance of evidence pointing towards his guilt in Patrick's murder, he has only been charged with obstruction of justice, due to his burial of the weapon used to kill Patrick. There is critical video and audio evidence that challenge DeBoer's self-defense plea. Notably, DeBoer deviated from his path home, admitting the he intended to confront Patrick by following Patrick to the gatehouse. There is no video evidence showing Patrick holding anything in his hands or acting in an aggressive manner when he got out of his car. Patrick was several feet away from the Gladiator when DeBoer attempted hit Patrick and physically harm him with his truck not once but twice, showcasing his violent intent. Furthermore, DeBoer positioned his truck to put Patrick o the passenger side and then purposefully rolled down his window, neglecting any claim to protection. He shot Patrick in the chest and drove away, leaving him to die. He never contacted the police, and under Utah law, individuals involved in an incident leading to injury or death are obligated to notify law enforcement immediately. DeBoer’s failure to do so should, at a minimum, lead to additional charges. He shot Patrick, buried his gun, and hid his Jeep for nearly 2 months. These actions would infer that DeBoer knew he had committed numerous crimes: engaging in road rage, shooting a defenseless man in cold blood, and attempting to avoid detection.
We respectfully request Wasatch County Attorney Scott Sweat and Prosecutor McKay King seriously consider the damning evidence outlined above as well as our community's call for justice and bring additional charges against Greg Kyle DeBoer for Patrick Haye’s death. It is essential to uphold justice and the safety of our community, and to give credibility to the new Utah Law HB30, which is intended to increase penalties and fines for serious road rage criminal behavior and discourage drivers from engaging in aggressive behavior. It is imperative DeBoer be appropriately charged and held accountable for his many criminal actions in a court of law through a jury trial.
