
PAGCOR finally responds --- and our fight moves forward to GCG and the Supreme Court
In the past days, our movement of excluded PAGCOR retirees has grown to nearly 200 committed members, all united by one goal: to correct the injustice caused by the arbitrary October 5, 2021 cut-off under EO 150.
Significant developments:
1. PAGCOR has replied to our lawyers.
As expected, they denied our appeal — citing the implementing rules of EO 150 and saying that retirees before October 5, 2021 cannot be covered.
This denial strengthens our case. It gives us the required “final agency action” needed to proceed to the next level.
2. Our lawyers have now formally escalated our appeal to the Governance Commission for GOCCs (GCG).
This is the mandatory administrative step before we can bring the matter to the Supreme Court of the Philippines through a Petition for Certiorari and Prohibition under Rule 65.
The GCG has 15 days to respond. After that, we proceed to the Supreme Court.
3. The collective action is almost complete.
Out of 191 retirees, 181 have completed all requirements, submitted IDs, received their SPAs, and are now part of the collective action.
Only a few are completing final steps.
4. What’s next?
Before our Supreme Court petition is filed, we have also submitted letters to:
* Senators
* Members of the House of Representatives
* The Office of the President
to broaden awareness of the injustice and seek policy support.
