The Issue
I would like to start by thanking Governor Jared Polis and his constituents along with the Weld County District Attorney Michael Rourke, and the US Attorney General Peter McNeilly, and Weld County Judge Audrey Galloway for their time on this matter as I understand the value; a lot of people need help. Matthew Alfaro is one of those people. Matt is currently serving a life sentence with no parole for a Class 1 felony murder conviction from 2005, later reduced to a class 2 felony murder charge in which he has maintained his innocence and immediately appealed. The appellate court found plain error, however, in 2014 changed the law after 60 years to reverse it. Weird. Have I mentioned he didn’t kill anyone. His uncle did and was convicted and sentenced for it 2 months later. So why was Matt convicted of the murder and given a life sentence? Contingent upon findings of absolute jury misconduct, and the testimony of (5-7) individuals all addicted to meth with open cases, that were offered personal gain in each circumstance to testify against Matt. After the initial statements of all said individuals, the 911 calls, and the redacted supplemental report of a CI (who was seated next to the DA the entire trial) all tell a different story, the truth. He was NOT at all facets of trial and his case is also inside the mishandlings of Yvonne Missy Woods. Had she done her job correctly DNA evidence would have exonerated Matt. Justice is long overdue. His constitutional rights have been completely violated. Matt is the first to admit his lifestyle choices, upbringing, and addiction to meth all lead him to make terrible choices resulting in lengthy sentences and where he is today. However, there are imperative details surrounding Matt's mitigation report that were not used in trial. I would like to note legislative action HB21-1209 passed in 2021, expanded the JCAP age up to 21, allowing for early parole to those who committed felonies and have served 20-30yrs, Matt was 21 and 2 months when charged. Removing his eligibility by 60 days. In 2004 a class 2 Felony Murder did hold a life sentence. In 2021 Colorado voters voted to remove the life sentence from this charge but did not make it retroactive. We are asking the courts to re-open and re-evaluate this case in its entirety. Matt has been exploited by his own uncle and then the justice system. His family, friends, and community stand with him. He may look bad on paper but to know him is to love him. He deserves a chance at freedom. To have a normal life, a real bed, a home, normal clothes, a job. He will definitely be a mentor to kids taking penitentiary risks due to a lack of self love and esteem, things he is very aware he himself lacked 22 yrs ago. Imagine being young, uneducated, encouraged to do drugs introduced to a gang lifestyle by the people who are supposed to guide you through life to succeed, and then being an easy target for a murder your uncle committed exploited in the name of love. Concrete walls of dangerous environments and solitary confinement have been Matt's life for 22yrs (29 with good time), over a terrible injustice, and biased sentencing. Those 22 yrs however have not been spent in vain. He is intelligent and taught himself to read during his first 7 yrs of solitary confinement sounding out the words. He studied history, and then theology, philosophy, and self help books. He could probably pass the bar exam on the first try. He is self aware, thoughtful, caring, disciplined. He loves nature, and animals. Despite limited access to educational programs due to his life sentence. On a murder he DID NOT commit. He’s been on the waiting list for certain classes for 22 yrs and when his name gets to the top, it just gets recycled to the back. I need your help in obtaining justice for him.
