The Issue

This is the hand if one hand of all law!!! This Is that thing that was done with the young boy that was killed in Johnsonville!! All 4 that were together friday night need to be charged the same!! Little Man did not deseve this at all!! All 4 in that group need to be charged with murder!! Especially the one that instigated the whole thing. He shook that man’s hand and left then turn around and came back in with the other two and that man ended up shot and killed.

In South Carolina, the phrase "hand of one, hand of all" refers to the legal concept of accomplice liability, meaning that anyone who participates in a crime can be held legally responsible for the actions of their accomplices, even if they didn't directly commit the act themselves. This doctrine essentially means that if multiple people are involved in a crime, the actions of one are considered the actions of all.
Here's a more detailed explanation:
Accomplice Liability:
The "hand of one is the hand of all" is a shorthand way of describing accomplice liability, where a person can be convicted of a crime even if they weren't the primary actor.
Participation is Key:
To be held liable under this doctrine, a person must have knowingly participated in the crime and aided or encouraged the principal offender.
Not Mere Presence:
Mere presence at the scene of a crime is not enough to incur liability. There must be some form of active participation, even if it's indirect.
Natural and Probable Consequences:
An accomplice can be held responsible for any crimes committed by their accomplices that are a natural and probable consequence of the original crime they agreed to participate in.
Example:
If a group plans an armed robbery, and one member uses a weapon to harm or kill someone during the robbery, all members of the group could be charged with the murder, even if they didn't directly commit the act of violence.
Defense:
A potential defense to accomplice liability is demonstrating that the person's involvement was limited to mere presence, or that the additional crime was not a foreseeable consequence of the initial agreement.
Application:
This doctrine can be applied in various criminal situations, including armed robbery, drug deals, and other scenarios where multiple individuals participate in a criminal activity.
