The Issue
I am creating this campaign to petition for Justice For Justin.
12 year old Justin was killed at the hands of Kyle Backhaus (KB) and his poor choices and all the courts charged him with a serious misdemeanor which is 30 days in jail, out in 20 days, and can do probation in another state due to traveling job. I would like to petition for more charges.
In the State Of Minnesota, If you drive recklessly you only get charged with Serious Misdemeanor even if you kill someone, it is still a Serious Misdemeanor. I would like to petition for a change in that law.
They ask victims to write an impact statement, however you are not allowed to address the defendant, so its hard to express the pain and hurt that was caused when it can't be expressed towards the defendant. I would like to petition to change these rules.
KB has also been being protected by Midwest Rides-Waknitz family. He was only caught and able to be charged when the owner of Midwest Rides, Jamie Waknitz reached out to the courts to see what fines there was and to offer to pay them on KB behalf.
At one of the hearings, Kyle Backhaus said "Well if there is a fine, I'll just pay it." as if nothing else mattered. To this day there has been no apology or any kind of remorse shown by him.

On July 26th, 2021, I, my sons mother, and everyone who knew Justin, lives changed. Justin was killed in a single vehicle accident, and it was at the hands of my now ex employee. This employee, Kyle Backhaus (KB), in the beginning was not interested in getting to know my son or really interacting with him. I didnt think a thing of it at the time as Justin was special needs and some people dont understand that.
As time went on we learned that KB had issues, he took several kinds of medicine and was still suicidal, often talked about how he felt homicdal at times, but still took his medicine and did his job so we figured it was under control, and he even started coming around to talking to my son and getting to know him.
Then that fateful day came. On July 26th, 2021 we pulled up to our next stop, and our ticket box was still in another location, so KB offered to go pick it up, but wanted someone to go along to keep him awake, as it was a few hours away and asked if Justin could go. Justin loved traveling and helping keep people awake. He was a very helpful child, he was always helping disabled people up curbs, reach items, help with groceries, so of course Justin was more then willing to go. Earlier in the day at 12:49pm he took a picture with me and my step daughter Lilly. Little did we know that would be the last picture he took. So KB and Justin set out on the road around 9pm. Everyone told KB to stop and pull over if he got tired, and to stay off the phone while driving. He said "ok I will pull over if need be and stay off the phone." Justin went around telling everyone bye and that he loved them and gave hugs and he told my youngest sons mother "if anything happens to me, tell my baby brother I love him" and she said "ok buddy, but we will see you when you get back" and he smiled and said ok and left. So KB made a few stops, getting food and shoes, then proceeded to head towards the ticket box.
Just after 11:20 pm, KB had been searching for music on the phone, and turning up the a/c while driving, to try to keep himself awake. Then proceeded to drift off to sleep and went into the center ditch, woke up tried to correct the vehicle to get back on the road and over corrected and was going around 75 mph at the time and rolled the vehicle at 11:26 pm. It rolled around 4-6 times and instantly killed Justin. KB walked away with bruised ribs and a few cuts/scrapes.
Since then Kyle Backhaus has been working around other children on a carnival called Midwest Shows and the the owners, the Waknitz family have hidden and protected him.
