Justice for Indiana Nurse Investigation. Many Questions, Very Few Answers.

This petition is for an Indiana Grand Jury Investigation into the death of a nurse in Sullivan County, Indiana, being presented to the Indiana General Assembly in accordance with Indiana Bill of Rights Article 1 Section 31. Please sign it to aid in the prevention of situations such as described below.  There was one vague cover-up story which is linked at the bottom with no follow-up released by all media outlets regarding this incident.  We believe that Leslie Shayne Miller's situation detailed in this petition and the very vague reports in the links at the bottom require much clarification.

Several questions that need to be answers regarding this very suspicious occurrence are: 

1. What became of the investigation conducted by the Indiana State Police Department involving the misconduct of a Sullivan County, Indiana sheriff's deputy against nurse Miller prior to her death?

2. Why was a single woman who was a nurse, and who lived alone in her own house, staying by herself in a motel room, allegedly with a firearm, in the county she resided in at 1:30 PM on a Wednesday? 

3. Was drugs and/ or alcohol alleged to be involved with the incident at the motel?

4. Who was the alleged firearm registered to at the incident at the motel? 

5. Why was there a confrontation and alleged stand-off between Indiana State Police and Ms. Miller after such a short period of time when everybody had been evacuated from the motel, and nobody was in any immediate danger, with the obvious exception of nurse Miller?

6. Where was she in the room when she was executed? The answer to this question would likely pose more questions.  

7. How many of the Indiana State Police officers shot her the three times she was allegedly shot in the chest? The answer to this question would likely pose more questions. 

8. Has the call to 911 and/ or dispatch been witnessed by anybody besides law enforcement? 

9. Was there body-worn camera video/ audio footage? If so, has anybody witnessed it besides the Indiana State Police Department?

10. Has anybody but law enforcement been interviewed? 

11. Has the coroner's report ever been observed by anybody besides law enforcement? 

12. Has anybody witnessed the crime scene photos besides the Indiana State Police Department?

13. Why has there never been a follow-up story that likely would have answered many of these questions?

According to sources close to her, nurse Miller had been attempting to expose abuse that she had suffered by a Sullivan County, Indiana sheriff's deputy, among other things, and this was the reason for the actions of the Indiana State Police.

The Indiana State Police have been an ongoing problem in Sullivan County, Indiana, for decades, but this is seemingly usually limited to extortion through infraction deferrals and illegal asset forfeiture. The ever changing Access to Public Records Act and Indiana State Police Department policies with seemingly no due process for these changes aid in obscuring their actions. Some of these issues are addressed and located in additional petitions.  

These very suspicious circumstances of the mother and nurse referenced above are described in the links below in a total of six sentences offered by the Associated Press, with seemingly no follow-ups or her alleged actions having received any benefit of doubt, and basically sums up the entirety of the media coverage of this event. I am attempting to get the reality of this exposed and petition for a grand jury investigation.  Don't wait until this happens to you or someone you know.  This is a common nationwide problem that needs to be recognized.

There are many issues in Indiana that are seemingly successfully obscured by our Indiana representative government and federal representatives.  Among the evidence that I have gathered there seems to be statewide First Amendment/ Access to Public Records Act violations, statutorily non-compliant actions and agendas such as tax funded campaign financing, professional licensure fraud, employment discrimination, mishandled evidence by the Indiana State Police Department, and much worse situations such as in the case of Leslie Shayne Miller found in the links below.  

Our First Amendment and other Rights are very arrogantly violated in Indiana by our representative government on a constant basis. The ideals put forth in Indiana IC 5-14-3-1 Access to Public Records Act are currently nonexistent.  The APRA laws are seemingly changed with no due process whatsoever.  If records are requested, they will have to be referenced specifically as Indiana Access to Public Records Act (APRA) requests. Referencing them as anything else is cause for denial. 

Although the term "information" is stated three separate times in Indiana IC 5-14-3-1, requesting only information is also cause for denial. However, receiving only informal information, if anything from the custodians of records is probable. They must be specific "reasonably particular" records requests. Unfortunately, reading comprehension does not seem to be typical in our representative government, so no matter how specific, the request will probably be deemed "not reasonably particular."

I also strongly suggest including the following statutes in full on each request. However, these statutes will likely have changed before or just after the records are requested: 

IC 5-14-3-9(a) requires acknowledgment of public records requests within seven (7) calendar days of receipt of electronic records requests. IC 5-14-3-3 provides the obligation to inspect public records unless they are exempt from disclosure pursuant to IC 5-14-3-4. IC 5-14-3-1 states that this chapter be liberally construed to implement this policy. IC 5-14-3-9 requires the custodian of the records to provide a written reason if it denies the public records request. 

If specific employee files are requested, I suggest including the following statute in full on each request: 

IC 5-14-3-4(b)(8) provides the statutory obligation to release: the name, compensation, job title, business address, business telephone number, job description, education and training background, previous work experience, and dates of first and last employment of present or former officers or employees of the agency.

The Indiana Access to Public Records Act laws will undoubtedly be violated. The custodians of the records will also undoubtedly reference the Indiana Public Access Counselor's "advisory opinions" when doing so. When this occurs, there will be a need to fill out the form in the link below and follow the instructions on submitting it to the office of the Indiana Public Access Counselor. This is a necessary step, but it will likely not resolve the issue.

Much of Indiana’s corruption is getting exposed now.  I have much evidence, but this is my primary goal at this time.  If this gets exposed, it will hopefully start a chain reaction. Indiana has been allowed to cover up corruption for much too long.
