Justice for Daniel

The issue

Hello, my name is Miranda, and I am Daniel's mother.

Daniel turned 27 on the 24th of June, 2022. Daniel was a smart, kind, considerate, hard-working, funny young man with goals and aspirations he was working towards. He was the kind of person who would take the shirt off his back or go without for people, especially his family and friends. He was enrolled and excited to be starting a bridging course so he could enrol in a Bachelor of Science on the 4th of July. He was a loving son, brother, grandson and friend.

On the 2nd of July 2022, I received the worst phone call a mother could receive. I was told by the police that my son "had been killed" and "he was deceased". Despite living in the Brisbane CBD, the Queensland Police Service somehow thought it was appropriate to tell me this on the phone.

I could not comprehend what I was hearing. I did not understand. I had only just spoken to Daniel two days before and we were supposed to meet up for brunch that day for his birthday. I do not recall much after this and have only been able to fill in the blanks from the people I called that I have no recollection of calling.

I collapsed.

My son had been killed, and the police said "It was just an argument" and closed the case, despite me telling them who was responsible and providing evidence to support my claims. There have been no efforts to procure statements from either family or friends or from the individuals who witnessed the abuse endured by Daniel in the hours leading up to his death. My son was not heard, and the system let him down.

I am going to be Daniel’s voice.

The coronial investigation is ongoing, but I am calling for the police investigation to be reopened and for the Coroner to hold an inquest.

Actions have consequences and you simply cannot take a person's life without accountability.

In November 2022, an Inquiry into the Queensland Police Service's responses to domestic and family violence made 78 recommendations, I am calling for all recommendations to be implemented in full.

I am also calling for reforms to the Coroners Act 2003 (Qld), just like the reforms proposed by the Hon Guy Barnett MP to the Coroners Act 1995 (Tas), as a result of Faith Tkalac's tireless fight in seeking justice for her son, Jari Wise (Jari's Law).

In summary, the Bill contains amendments that update and clarify five different Acts in the Ministers justice portfolio, including the Coroners Act, where a further category is added to make inquests mandatory, where the Coroner suspects that family violence materially contributed to the death.

Family violence substantially contributed to my son Daniel's death. He was an aggrieved person under a police-initiated protection order at the time he was killed, having been attacked with a knife mere months beforehand by a person. Instead of charging this person, it was thought a piece of paper would suffice as a deterrent. Of course, this did not stop this person from then sending others to threaten him with machetes as payback in April because he could not have the order removed. Then came the false complaints to the police (which extended to me after they killed Daniel). This individual was relentless in their abuse of my son until finally, they made sure he could defend himself no longer and he was silenced.

Domestic violence is a serious issue that affects people of all genders, ages, and backgrounds. While it predominantly affects women statistically, it is crucial to recognise that domestic violence against men is a real but often marginalised issue. One contributing factor to the underreporting of domestic violence against men is their hesitancy to come forward. They may have concerns about not being taken seriously or fear being held accountable for the abuse.

Nothing will bring my son back, but society needs to recognise that domestic violence can happen to anyone. I am doing this in memory of my son Daniel and all victims of domestic violence who deserve support, resources, and protection.

Please share and join me in my fight for JUSTICE! Not just for my son, but for all men who are victims of domestic violence, and for those families that have had to endure this pain.
