The Issue

On April 3, 2023, a vehicle driven by Bernest Miles crashed into a home on Pond Street in Syracuse, New York. The incident was serious and frightening, and our hearts remain with everyone affected.

However, serious questions remain about how this case was investigated, charged, escalated, and ultimately resolved—questions that demand transparency, accountability, and review.

What the public record shows

According to contemporaneous reporting:

Police initially charged Bernest Miles with Driving While Ability Impaired by Drugs (DWAI–Drugs) and traffic-related offenses.
Police stated that injuries were non-life-threatening.
Syracuse Police publicly misidentified the vehicle involved, later issuing a correction—raising early concerns about accuracy and reliability in the investigation.
No mention was made at the time of felony assault charges or any shooting-related allegations.

What the family reports

Bernest Miles’ family states that:

Despite the initial charges and public narrative, the case was later escalated to a felony assault conviction, resulting in a six-year prison sentence.
Bernest has a documented history of serious mental illness, including schizophrenia, and was experiencing psychiatric instability before and during the incident.
Mental health evaluations and mitigation were not meaningfully addressed during prosecution and sentencing.
Authorities are now allegedly pressuring Bernest to plead to a separate shooting allegation, despite no clear evidence being presented to the family and no publicly identified charging instrument tied to that claim.

Why this raises serious concerns

This case presents multiple red flags that warrant independent review:

Charging Escalation Without Public Clarity
The initial charges reported do not align with the severity of the final sentence described by the family, raising questions about how and why the case escalated.
Credibility and Accuracy Issues
Early public errors by law enforcement—such as misidentifying the vehicle—cast doubt on the precision of the investigation and reporting.
Unresolved Mental Health Factors
When serious mental illness is present, courts are obligated to ensure competency, voluntariness, and appropriate consideration of mental health. Failure to do so undermines due process.
Allegations Without Transparency
Any attempt to pressure a plea for a separate alleged offense without clear evidence, documentation, or a formal charging record raises profound constitutional and ethical concerns.

What we are asking for

We are calling for:

An independent review of the investigation, charging decisions, and sentencing in the case of Bernest Miles.
Full transparency regarding any alleged additional charges or plea pressure, including disclosure of case numbers, evidence, and charging instruments.
A review of whether mental health evaluations, competency standards, and mitigation obligations were properly met.
Public accountability for any procedural errors, credibility issues, or due process failures that may have contributed to an unjust outcome.

This petition is not an attempt to excuse harm or minimize accountability. It is a demand for fairness, accuracy, and justice—principles that must apply to every person, regardless of circumstance.

When errors go unexamined, trust in the justice system erodes. When mental illness is ignored, injustice follows. And when convictions are built on unclear or shifting narratives, the public has a right to ask questions.
