Justice for 15 y/o Nayan Santani:Accused must be tried as an adult & school be held liable

The Issue

We the people belonging to the Sindhi community along with every fellow citizen across the country , concerned with human rights and justice stand united in grief after the brutal murder of the 15 year old Nayan Santani . 

Nayan Santani was stabbed by his school-mate in the immediate vicinity of his ‘Seventh Day Adventist Higher Secondary School’s’ campus and he eventually succumbed to his injuries. 

There have been alleged Instagram chats where the accused himself confessed to the crime. When asked by a friend if he had stabbed, he replied: “Haan to.”

He further said: “Jo hogya vo hogya,” showing shocking indifference.

Even his friend, of the same age, responded with rationality, saying: “Maar nahi daalna tha, could’ve just hit him.”

This proves two things beyond doubt:

1)The accused was fully aware of his actions and the consequences.
2)He has shown no remorse  whatsoever

Moreover, the accused has also claimed that the reason behind his stabbing Nayan Santani is the latter telling him “Kon hai , kya karlega tu?” This shows how this cold-blooded act was ego driven, planned and calculated and not grave and sudden provocation (defence in murder cases) . 

A qualified psychologist should be appointed to assess the mental rationality and capacity of the accused and the reports of his conduct must be obtained from his peers, the school , family . These findings on establishing his mental capacityshould ensure that he be tried as an adult for this barbaric act under section 103 of the Bharatiya Nyaya Sanhita .

A school is supposed to be a child’s second home but how are parents supposed to feel that sense of security after this incident?
According to the police, after being stabbed when Nayan stumbled near the school gate, the school staff and authorities failed to provide timely assistance and 30-40 critical minutes were lost which could’ve otherwise possibly saved his life . It is also alleged that the school authorities summoned a water tanker before rushing him to the hospital.

The school must be held fully accountable and liable for violating:

Nayan’s Right to life under Article 21 of the Constitution , the Union Ministry of Education’s 2021 ‘Guidelines of School Safety and Security under the provisions of Right to Education act and Juvenile Justice Model Rules, Sections 106(1) and 202 of the Bharatiya Nyaya Sanhita , principles of natural justice .

Sign this petition because Nayan Santani deserves justice and for no such tragedy to ever repeat again.
