Last Wednesday after the disappointing meeting I had with some people from Choose Love at the Impact Hub of Athens, where I was initially looking to get in touch with Refugee Legal Support but couldn’t find them there, I decided on going to the office of the European Lawyers in Lesvos as well to find out why haven’t they responded to any of my emails sent to them over the past few years.

At their address, I couldn’t find any sign at the door pointing visitors to their office. After ringing several of the places hosted there, finally someone opened the door for me. But even inside the building, still it wasn’t so easy to find their office.

Finally, at their office, as I was recording, I asked to see and speak with the Director to find out what was the reason for their utter negligence in not responding to any of my emails, despite years of continued unilateral communications with them.

But the Director was not there. So, the people at the office, mostly very young and inexperienced employees, placed a call to someone by the name [REDACTED] who said was [REDACTED] and promised to personally take care of my issue and get back to me within 24-hours.

The next day, however, another person called who also said was the Managing Director. His name Philip Worthington. After acknowledging to have read my emails, particularly the most recent one, which was sent to them on September 26th, 2022, he sincerely apologized for not responding to any of my emails and also explained why their organization could not be of any assistance with regards to my case.

After hearing what he said on the Phone, I also asked him to send me a written response, which he agreed to but only did so after getting another reminder from me the next day on Friday. His written response came several hours later.

Below is the content of their written response.

“Dear Mr Nillufary,

Thank you for your email.

Thank you for the call yesterday and for explaining the situation in more detail.

First of all, please let me again apologise for the delay in responding to your emails. I am sorry that it took me so long to reply and that you lost time and energy in following up with me.

As discussed in the call yesterday afternoon, unfortunately European Lawyers in Lesvos gGmbH (ELIL) cannot assist you with your case. We are an organisation with a very restricted mandate – we are only able to assist refugees with their first instance asylum application. Unfortunately, we cannot assist with any other types of cases – we cannot support with appeals, with any cases at the Greek court or with any cases at the European courts. In particular, our Articles of Association expressly prohibit us from assisting with the type of case you would like to bring (our Articles of Association is the document that governs our organisation and sets out what we can and cannot do). This is not a policy decision of the organisation, but rather a prohibition set out in our founding document. A copy of our Articles of Association can be found on our website (here) and the relevant clause is 2(1) (page 3). The relevant wording is:

“The Company will only provide first instance legal assistance (which may include representation) and not strategic litigation”

Moreover, even if we were able to assist you with your case (which we are not), we do not have the necessary expertise or experience to help you. Our team of lawyers focuses solely on supporting refugees with their first instance asylum application – we have never brought a case at any of the European or International courts and so do not have the expertise or experience to assist you.

I am very sorry that we cannot be of assistance with your case and I apologise again for the delay in responding to your emails.

So this was the response they sent after so many years of communication with them, which came only after visiting their office and video recording it.

That’s the mentality of the people a Refugee has to deal with in this country.
