We ask the court to deny bond for convicted killer, Trevor Dooley

The Issue

Dear Honorable Judge Barber, We The People, respectfully request that bond for Trevor Dooley be denied during his new trial for the reasons stated below. A brief background of the events that took place on Sept. 26th, 2010 - present time: David James, a 20 year military veteran, and his then 8 year old daughter, Danielle James, were playing basketball in their Twin Lakes subdivision park when they were approached by a 14 year old boy asking if he could ride his skateboard on the other side of the basketball court. David James agreed. Trevor Dooley observed this from his home across from the park. Dooley then started yelling for the boy to go away. Dooley walked across the street and into the park to confront the boy. James stood up for the boy and words were exchanged between Dooley and James. At this point Dooley lifted his shirt exposing a gun he had in the waistband of his pants. A struggle then took place, as James felt threatened for the safety of the children and himself. This is when Dooley fatally shot James in the heart. The above events were all witnessed and testified to by the boy skateboarder, Danielle James, and two adult tennis players. Trevor Dooley was found guilty of the manslaughter death of David James and other charges on Nov. 19, 2012, and was sentenced to 8 years in prison by Judge Ashley Moody in Jan. 2013. In Feb. 2013 was granted bond to await his appeal, and in Nov. 2014 after all appeals were exhausted Dooley finally began his prison sentence. In April 2016 Dooley was granted a new trial because of incorrect wording given to the jury in closing statements by the prosecution. The evidence, which proved his guilt initially, is overwhelming, and there is not adequate evidence to support any other decision. Being born and raised in another country, and at his current age, facing death in prison, Dooley should be considered a flight risk. Similar cases where bond was denied post conviction: State of Florida vs. James Ward. Honorable Judge Heather Higbee State of Michigan vs. Andrew Barbick. Honorable Judge James Kingsley In the bond hearing of Dennis Oland, Honorable Judge Marc Richard cited, RELEASING HIM PENDING HIS NEW TRIAL WOULD UNDERMINE PUBLIC FAITH IN THE JUSTICE SYSTEM . "Although the grounds of a new trial may be clearly arguable, none fall in the category of the unique circumstances that would virtually assure a new verdict or acquittal".
