Judge Schmalberger, Denver District Court: Abide by the mandate of the Court of Appeals, Colorado.

Please sign this petition regarding a young child, “L.N.” and her family, Lori New-Bohner, David Bohner and their other two children. The oldest is now separated from her family. Lori was granted by the Colorado Court of Appeals a retrial, but has never been allowed to schedule one in Denver District Court. The Appeals court also issued a void judgment on two separate occasions regarding Judge Donna Schmalberger’s order to terminate custody of the oldest child, the matter on which the retrial was to be based. Lori has fourteen days to file for reconsideration and for emergency relief from September 6, 2013, again in Denver Judge Schmalberger’s courtroom, after which she will have no other legal remedy but to reenter the appeals process once more. It appears that this Judge is disregarding the directive of the Appeals Court by not scheduling a retrial. Although the child was removed from the family for three years, the child saw her mother three weeks before this hearing and she has expressed a strong desire for consistent contact with the mother, the father and her siblings. The statutory conclusions of law used in separating L.N. with her family are repugnant to the Constitutions of the state of Colorado and of the United States. Lori New-Bohner is seeking the due process and the family’s rights under the Bill of Rights and Amendments thereto, and under rule of law all Americans should come to expect in courts dealing in family matters to maintain the parent/child bond, with no more delays. We would like to note that this petition is in no way a referendum on Judge Schmalberger’s character; we merely seek appropriate action in light of any decision that hurts this child, her family, and our community by any breach of duty and/or by acts of mistrust by any public official, friend or officer of the court, public or private, against those he/she has jurisdiction to serve. Please sign our petition for an order immediately granting retrial for the return L.N. to her family by Denver County District Court, Judge Donna Schmalberger or one of her colleagues. Please keep all petition comments appropriate and respectful.
