The Issue

Dear Judge Warhit, I am a concerned Westchester County resident. I have been following the media coverage of the Brendan Cronin case that occurred on April 29, 2014. As you know, on that date completely innocent victims Rob Borrelli and Joseph Felice from our Westchester community, while enjoying the civil liberties to which we are all entitled, were maliciously attacked. This attack was from an unprovoked, intoxicated off-duty NYPD Officer. He unloaded his service weapon into their car striking and grievously injuring Mr. Felice. This is a travesty on so many levels. I am writing because I believe these actions are completely unacceptable in our community and that justice needs to be served. I understand that in the resolution of crimes, negotiations are apt to occur which can shorten sentence term. I also understand that sentences maybe reduced for good behavior. The media reports that Officer Cronin has been indicted on 2 counts of attempted murder, 2 counts of felony assault and a driving under the influence offense. Four out of these five charges each carry a sentence of 5-25 years in prison. As a citizen of our community with no regard to color, race, or status, I urge you to consider what we residents expect of our law enforcement, and of each other. The events that occurred on that night certainly were no accident—they were inflicted by a man who took an oath to serve and protect. They were inflicted by a man who carries a weapon with the understanding that he is constantly "fit for duty". I urge you to let this incident (and its resolution) be a benchmark and set a standard for expectations of law enforcement and our citizens. The consequence of such a crude and heinous act must be equally as painful. I worry about our community when going to a grocery store or driving a child home from school isn't safe anymore. We need to ensure that we, and most importantly our children, have trust and respect in the legal system and its law enforcement. Hence, I respectfully request that your sentencing reflects the severity of this crime, irrespective of his law enforcement status. A similar crime, committed among citizens would be awful. The fact that this incident involves one of New York's Finest, and was completely unprovoked makes it heinous. Please do not diminish the importance of the guilty verdict with a relatively short sentence. Any sentence below the high end of the range would be a harmful injustice to these completely innocent victims and our Westchester community. Sincerely,
