Joey Fondaco to be charged for 2nd degree murder under Code Section 18.2-33
The Issue
This petition has two goals. We want Joey Fondaco to recieve the maximum sentence allowed by Virginia law for the 2 felony drug charges connected to the death of Hailey Moore. The second goal is to pursue a Federal or State case where he can be charged with murder in connection with her death. We are sending this petition to the Commonwealth Attorney in Rockingham County, VA and the US District Attorney for the Harrisonburg area.
On November 9, 2016 Hailey Ryan Moore, 18 of Gretna, VA and a freshman at James Madison University (JMU) texted her friend at 9 am and told him she would be ready for class in 30 minutes - she asked him to pick her up from Joe Fondaco's apartment. Joseph Thomas Fondaco is a native of Leesburg, VA and was her "boyfriend" of two weeks. He wasn't a student at JMU - he was a former student - we aren't sure if he dropped out or was kicked out. When her classmate arrived around 10 am she wasn't answering his texts to come out to his car. He finally walked inside and found Joey Fondaco and Hailey's lifeless body in the apartment. Her classmate attempted CPR but when he realized it was unsuccessful he took her to the ER. Joey Fondaco accompanied him with Hailey's lifeless body. Her lips were cyanotic and her eyes were wide open. The staff at the ER were able to revive her and keep her alive for 40 minutes or so. The doctor called her mother and told her that Hailey was at the hospital and hanging on by a thread. It wasn't good and she needed to come right away if she wanted to see her daughter alive. Harrisonburg was at least 2 hours from any immediate family member. No one was able to make it before she was pronounced dead at 11:21 am that day. When her mother and father arrived they were briefed by doctors and the police. The police allowed her parents to talk to Joey Fondaco.
Her mother asked Joey what he had given her daughter and his response to her was "the police are being a##holes to me". He never showed any remorse. He did admit he knew the cocktail of drugs found in his apartment were lethal when mixed. He never said he was sorry. He has been uncooperative with the authorities refuses to unlock his cell phone. He was arrested that night on 2 felony counts after a search warrant was executed on his apartment. He has a criminal record - was currently on probation for a prior drug charge that would have been lifted in January 2017.
The Justice4Hailey we seek is for Joseph Thomas Fondaco to serve the maximun sentence allowed by the Commonwealth of Virginia for the 2 felony charges. We want to pursue charges for murder under the federal or state statue for his role in her death (pending toxicology reports from the Medical Examiner). We also want him punished to the fullest extent of the law for the two felony drug distribution charges (court date 13 Dec 2016).
This may sound harsh but think about the 70 or so years that were taken from Hailey and her family. Her father will never walk her down the aisle, she will never graduate from her beloved JMU, and never give birth. She will never follow in her mother's footsteps of becoming a CPA.
There is no way we can bring Hailey back but we can honor her memory by demanding that Joseph Thomas Fondaco gets the punishment he deserves for his uncaring and selfish behavior. He is a monster that has been allowed to get away with everything up until this point. He needs a reality check.
He has no remorse and if her classmate hadn't come to check on her we have no doubt he would have dumped her body in a ditch. He has never been held accountable for anything in his life. He doesn't understand that actions have consequences. His parents have afforded him the best law defense for his prior charges to keep him out of trouble.
He will not get away with it this time. He has to pay. We are sure his parents assume Hailey is of no concern and may not even know the full circumstances of their son's arrest.
Hailey was a honor student, graduated with full honors and was a Student of Merit at JMU. She was a cheerleader all four years of high school and Student Government Representative. JMU was her first choice for college. She had worked hard to get there. We were all hopeful for her future. Now there is no future for Hailey.

The detectives have told her parents he would probably only get Community Service. This is because he has been uncooperative with the police and refuses to help answer any questions. The cause of death is still PENDING from the Medical Examiner awaiting results of her toxicology reports (this can take months to get back). We may never be able to prove a homicide or manslaughter charge but we can insists he gets the maximum time allowed under Virginia Code for the two felonies he has been charged with since they are directly related to the death of our sweet Hailey. This isn't his first offense - he was found guilty of trespassing and petty larceny in his hometown of Leesburg, VA over the summer and was on probation for a prior drug offense in Harrisonburg from December 2015. We want Justice4Hailey. Her parents will be establishing a scholarship in Hailey's name - please stay tuned for more information.
