After requesting via FOIL all the Inspection reports on all embankments, spillways and culverts between Pittsford and Fairport for the past 20 years, I eventually received 68 reports. Many of them had been redacted and had no useful information as to the overall state of the subject areas. The attorney for the NYPA said - "our request is granted, in part, and denied, in part. Please see attached. Please note that some of the records have been redacted on a ground that they constitute intra or inter agency materials and are exempt from disclosure provided they are not (a) statistical or factual tabulations or data; (b) instructions to staff that affect the public; (c) final agency policy or determinations; or (d) external audits, including but not limited to audits performed by the comptroller and the federal government (see Public Officer’s Law §87[2][g]). Additionally, certain information regarding inspections on spillways, culverts and embankments have been redacted on the ground that the information requested is considered Critical Infrastructure Information (CII) as defined in Section 86[5] of the New York State Public Officer’s Law (“POL”). As such, it is not subject to disclosure pursuant to POL §87(2)(f) as release of the requested records could endanger the life or safety of any persons." I have copied many of the photographs in the reports and this is a slideshow of them. Very few of these problems have, it seems, been resolved. I have the complete report file if you want it.
