The Issue

On December 3, 2021, I lost my 29-year-old son to a failure-to-yield collision.

In South Carolina, the driver who caused the crash received only a $100 ticket. There was no court appearance. The citation was simply paid online.

What makes this even more troubling is that South Carolina's failure-to-yield citation does not include a place to indicate whether the crash resulted in severe bodily injury or the loss of a life. When that ticket reaches a judge, it can appear to be just another traffic citation—without reflecting the devastating consequences behind it.

What if this driver had been a repeat offender? What if another family had already lost someone because of the same person's negligence? How would anyone know?

 Shouldn't our justice system recognize the difference between a routine traffic violation and one that forever changes a family's life?

The current failure-to-yield law in South Carolina is inadequate. It needs stronger accountability, meaningful consequences, and a process that recognizes when a preventable crash results in serious injury or death.

No family should have to endure what ours has experienced.

We are losing far too many lives because of failure-to-yield crashes. Every one of those lives mattered, and many of these tragedies could have been prevented. It's time we take action to make our roads safer for everyone.

In South Carolina, failure-to-yield crashes are a significant cause of fatalities and injuries on our roads. According to the Insurance Institute for Highway Safety, in 2019 alone, there were 2,678 reported failure-to-yield crashes in the state, resulting in 60 fatalities and countless injuries. These numbers are not just statistics; they represent real people with families and futures that were tragically cut short.

Passing Bill H.3173 can be a vital step in preventing these unnecessary tragedies. This bill aims to strengthen accountability for failure-to-yield incidents, potentially saving lives by mandating stricter enforcement of traffic laws. By imposing increased fines and meaningful consequences, we can encourage drivers to be more vigilant and conscientious, reminding them that a few extra seconds of caution could mean the difference between life and death.

We need the South Carolina General Assembly to recognize the urgency of this issue and act swiftly to pass H.3173. With stronger laws in place, we can create a safer environment for drivers, passengers, cyclists, and pedestrians alike. These improvements not only offer justice for those lost but can prevent future accidents, sparing other families the pain and suffering of losing a loved one.
