In 2008 my son Andrew Hoeft-Edenfield, age 20 yrs old was walking with a friend when they were chased and beaten by 10 UC Berkeley Fraternity boys as they walked by the Sigma Pi. Fraternity House. My son feared for his life and took out a knife. He warned the Frat boys he had a knife. Everyone heard him yell that I have a knife let me go. One boy jumped my son from behind and was accidentally stabbed. That boy had a blood alcohol level of .23.  This boy died on the way to a “trauma center” hospital 50 minutes from the scene, rather than be admitted to Alta Bates Hospital which was 10 minutes away. Sounds like a self-defense case. If you are attacked can’t you defend yourself?  My son was charged with 1st degree Murder and was convicted of 2nd Degree Murder. He was sentenced to 16 years to life in prison. In 2014 he won his Supreme Court Appeal with a Habeas Coprus Appeal and all charges were dropped. Nancy O’Malley, District Attorney of Alameda County told my son after he won his Appeal that he had a choice of going to trial again as they were going to re-charge him or take a deal. The deal was for Voluntary Manslaughter for 12 years but he could only obtain this deal if he gave up 3 years he already served. At the time he won the Appeal he had served 6 years of his prison term. Giving up prison time one has already served is called “waiving credits.” My son agreed to give up his three years so now he is serving 15 years on a 12 year sentence and is re-serving time he already served. While in prison my son has completed an Electronic Program, has had several jobs, taken every workshop he has been offered inside prison, and is now working on his AA Degree in Business. At the time of his arrest he had no previous record and was enrolled in college and working part-time. It is very tragic that this boy lost his life but my son doesn’t deserve to re-serve prison time he has already served for this tragic event.  I started this to petition to ask Governor Brown to give back to my son the 3 years he has already served. My son's name is Andrew Hoeft-Edenfield.
