STOP Excel Parking Fines in Precinct Car Park, Chorlton.

The Issue

Appealing to the Local MP for Chorlton, Jeff Smith: Stop Excel Parking from unfairly fining residents of Chorlton. Residents and visitors to Chorlton are legally using the carpark as a through road in order to access their properties or parts of the village. The car park uses registration identification and has fined motorists for being in the car park without using a space, e.g. driving through on way to work, and back again later in the day. It does so using proof of registration through photographic images and tracking the vehicle owner via the DVLA. Fines to locals in some cases have exceeded £5000 according to the MEN.  Issues with the hostile approach of Excel is also having an effect on local businesses and shops in the Precinct Shopping area, due to the difficulty of parking and the related fines to the community.  There is a grace period of ten minutes stated in the terms and conditions but most Chorlton residents have been fined up to £100, even when not occupying a space. The company continues to collect such 'debts' from unsuspecting locals and visitors. There is no barrier on the carpark entrance and exit to show it is private land.  Excel have been published in the media and local forums since 2011, even as far as stated by Money Saving Expert, Martin Lewis as 'Cowboys' and also featured on Watchdog in 2011.  Excel are now defending themselves through evidencing the Parking Eye vs Beavis case, which was taken to the Supreme Court in 2015, where Parking Eye won. However, how can this company defend themselves and remain fining residents when motorists are not using the spaces? This petition is not supporting the illegal use of private car parks, i.e. to park and refuse to pay, instead it is voicing the unlawful 'debt' collecting from Excel to Residents who have not used a parking place.
