The Issue
CPS Investigator, Brooke Martin, in Walla Walla, Washington has repeatedly violated the rights of a family in her jurisdiction. Two advocates from the Fight for Lilly Foundation were present to witness numerous violations under Ms. Martin's claim to lawful authority.
The single mother, who wishes to remain anonymous for now, agreed to remove the children from her household over a hearsay allegation, and granted guardianship to family members until the situation can be handled. She is currently living without her children in the home.
The mother agreed to meet with Ms. Martin and during the meeting, when she invoked her constitutionally protected rights to not answer questions without an attorney, and refused to sign a "safety plan" that Brooke was demanding, Ms. Martin became enraged, slammed her hands on the table, and threatened to remove the children from the home because the mother was not cooperating.
The mother left the meeting, and emailed Ms. Martin to reaffirm that they were invoking their rights to due process, to remain silent, and to have an attorney present to look over any legal document Ms. Martin wanted them to sign. Brooke wrote them back and requested another meeting, this time to inform the family of their rights as CPS clients, which includes their right to an attorney and due process, despite her failure to do so at the first meeting.
The mother responded once again with the invocation of their constitutional rights to due process, and requested that Ms. Martin only contact them through the appropriate legal channels and refrain from harassing them any longer.
Ms. Martin retaliated by filing a petition filled with hearsay and lies, stating the the mother was incapable of taking care of her children. This was done in an effort to remove the children from their home, despite the children not even being in their home.
When she attempted to remove them from the home, and discovered they were still not in the home, she proceeded to harass the mother by showing up at her work with a police officer to again attempt to intimidate the mother into cooperation. She humiliated the mother by using the business' security officers to parade her across her work place, and wrongfully detain her for questioning without an attorney present.
Once again, the mother has insisted upon her rights to Due Process and told Ms. Martin that she will see her in court instead. A hearing is scheduled for Wednesday, July 29th, in a Walla-Walla Superior Court.
Brooke Martin's use of humiliation, intimidation, coercion and conspiracy against this mother's Constitutionally protected rights to remain silent, have an attorney present, and be provided with Due Process when alleged to be a neglectful or abusive parent are unlawful abuses of the power bestowed to Ms. Martin by the State of Washington.
The tax payers provide the funding to pay Ms. Martin's salary and the trauma being forced upon this family and these children is not what they have in mind when they pay their taxes. They did not give her authority to protect children so that she could abuse her powers and harm them instead.
It is time for her to get a new job.
