The Issue

Dear Governor Janet T. Mills and The President of The United States, Donald Trump:

My name is Cerys Victoria. As I sit here eating my breakfast, I am disgusted by the fact that my former Stockton Springs neighbor Jason "Swingset" Moody will not get to do the same simple act every day. To wake up in the morning and eat breakfast. I'm disgusted by the fact that such a lighthearted soul would never grace our presence on Stagecoach Road in Stockton Springs, Maine. Never again would he randomly pop by to say hello and come by on holidays. The day Jason Moody was murdered was the day the music stopped playing in our neighborhood. Children wouldn't get to finish their music lessons with Jason. A beloved uncle, son, and best friend of many taken from the Maine community.

This past week, as the University of Maine posted evacuation orders due to the pandemic, I witnessed the sentencing trial of Jason's killer, Donald Galleck, who only got EIGHT YEARS of prison time with time served meaning an even lesser sentence. His earliest release date is April 13th, 2025!

I am sickened beyond belief that this could occur, and I write to you during this pandemic, begging you to bring the iron hammer of justice down for my neighbor's killer, Donald Galleck. I hoped that briefly, you might have seen my sign on WABI and Fox News 22 Bangor. I sat outside the courthouse with a poster I made that said, "End The Alford Plea!" I was almost a nurse, so when they read the autopsy report, I truly understood the extent and pain, the evil that my neighbor experienced at the hands of a murderer, Donald Galleck. I was unable to eat for the rest of the week. The details swam around in my medical terminology head, and I cried for my neighbor Jason Moody.

I implore you that even in times of unprecedented global uncertainties, we, the great State of Maine, should not allow such sick individuals like Donald Galleck and Sharon Carrillo to get some of the state's best lawyers for free and be able to use the Alford Plea. It is a disgrace to Maine and justice itself. It is an immeasurably unkind thing to do to Jason's family to put his name on Maine's murder victims' wall but not give them the justice of a murder sentence toward his killer and not give them an equal lawyer to Wendy Hatch. We encourage your review of the state attorney who handled the case because we feel if he had gone before a jury, Donald Galleck would be a guilty murderer.

My name is Michael Hall, and Jason Moody was my best friend. The outcome of Jason Moody's case shows disregard for many vital details, either for conviction rates of the lawyers or laziness. Donald Galleck has three prior assault charges, one of which he was sentenced for another 11 months the same day he received the 8-year plea deal; the other assault was on a close family member of his, which he attempted to use his foot to crush the family members chest. The night Donald Galleck assaulted Jason, he got asked to leave by Jason because Donald had become physical with his girlfriend, and Jason did not want anyone hurt. Another thing would be that the Bangor Police department never searched Jason's apartment or vehicle. If they had, they would've found $200 cash in Jason's glove box (located by Jason's mother later), which ultimately means the original statement Donald Galleck stated he was defending himself from a robbery was false. Not to mention, Jason was gainfully employed as a painter in Rockland, Maine for Crockett and Crockett, and expected to work the following Tuesday.

You cannot say that you have the consciousness to beat someone so badly that they have a fractured jaw, skull, and caused massive organ damage, then go on the run after hiding the sweatshirt with Jason's blood on it in someone's bathroom. Calling someone on the phone and telling them you're aware you're "going away for 15 to 20 years." Donald also bragged about putting Jason in the ICU and Eastern Maine Medical on social media, which inevitably was what got him caught. All those are, without a doubt, conscientious actions of someone who was intentional and aware of what they were doing, and that is why this should not be an Alford Plea. Jason had scratches on both his hands: inside on his palms and fingertips and defensive marks on his knuckles, meaning he attempted to defend himself but also tried crawling to safety after realizing this was not just a regular fistfight between two even-headed individuals.

One more colossal fact is that Jason was extremely intoxicated that night. Donald was not. Intoxication meant Jason was very unstable on his feet, his reflexes and responses delayed by alcohol, and in no way was Jason prepared for what Donald did to him. In my opinion, this is no different than taking advantage of an older adult or a child. Jason Moody suffered unnecessary pain at the hands of Donald Galleck, and the closure of his final wishes denied due to him being a murder victim; he did not get to donate his organs. Jason would also never had the opportunity to be a father, which was his greatest wish.
We've never felt so strongly about something in life and want to ask for you to meet with Jason's family, give them the justice that they so profoundly deserve for the loss they suffer every day. Bring Justice for Jason Moody!! End the Alford Plea! Sentence Donald Galleck for murder!
