The Issue
It is the claim of James R. Caputo, MD, a board certified Obstetrician and Gynecologist from Syracuse, NY that in 2002, the NY State Department of Health (DOH) and specifically, their notoriously abusive Office of Professional Medical Conduct (OPMC), after receiving multiple intentionally disparaging letters from a certain party connected to his hospital department under the protection of "anonymity", began a completely baseless and malicious prosecution against his previously pristine medical license and career for matters that were either completely fabricated or so grotesquely distorted from actual events so as to "imply" the appearance of wrongdoing, that after thirteen years of futilely fighting these lies, it unjustifiably did result in the loss of Dr. Caputo's license.
Dr. Caputo contends that during the time period of 1998 and 2008, (the years of practice involving all cases used in his prosecution), when he was a high volume provider on staff at Crouse Hospital, that his performance record as an Ob/Gyn physician and pelvic surgeon was amongst the best in all of New York State. That all records not only bear this out but that OPMC knows full well this statement to be true.
Dr. Caputo contends that if any of the charges used against him were brought into an open and honest setting, with the medical records and the official standards of care in evidence, that none of this thirteen year OPMC prosecution could ever stand.
Dr. Caputo contends that in addition to literally all truth and legitimate Obstetrical and Gynecological medicine being completely disregarded, numerous rules and statutes were also manifestly violated by OPMC not to mention his constitutional rights, as ALL of these proceedings occurred in a tribunal-like setting - ALL done at taxpayer expense. A process so vile and dishonest that the first of two hearings against Dr. Caputo had to be thrown out by the Appellate Division of the DOH for corruption involving OPMC and a jury infiltrator.
Dr. Caputo contends, without equivocation, that OPMC knowingly and willingly forced a known lie through their prosecutorial process and thus fraudulently, (in essence), stole his very career from him, thus causing massive personal, familial and financial fallout. He contends that they know full well that this is the truth and have been unwilling to rectify the matter.
Dr. Caputo has a pending official petition/appeal before OPMC that presents compelling evidence to have his entire record cleared. It remains un-responded to for nearly five months, as of mid-June 2015, with a deafening silence.
Dr. Caputo contends that despite numerous letters to OPMC, as well as other official state offices such as that of the Governor, Commissioner of Health and the Office of Inspector General, that the reason there has been no response from anyone is because the entire prosecution was a lie and the lie has finally been cornered - thus disabling any kind of response other than admission and submission.
Therefore, James R. Caputo, M.D. seeks your voice through this petition in challenging the Office of Professional Medical Conduct to an open public hearing - a DUEL if you will - involving any and all medical cases used against him that resulted in the robbery of his career, practice, name, reputation, medical license, livelihood, family, and the truth.
