Jains Westminster: Compensation for loss of Interiors - Fixed percentage

Subject: Requesting compensation for loss of Interiors - Fixed percentage - 15 percent of total flat cost
In compliance of the orders of the Hon. High Court as also for their own safety, all apartment owners have vacated their flats in Jains Westminster apartment complex by the end of June 2024.
In their report III dated July 18th 2024, section 6 and report IV dated July 29th 2024, section 5, the Hon. Committee has been insisting on taking the photographs and videographs of the improvements made by flat owners in their flats in order to compensate for their interior losses and handing over of keys. Owners also have been sending emails to the Hon. Committee regarding this aspect from the month of May 2024.
As there was no development in this regard and also due to the fact that the workers of Jain Housing had forcibly opened the flat doors and had stolen many items of value including air-conditioners, some owners removed their interiors and gave it away free or as scrap for negligibly low prices.
Apart from the loss of interiors, a huge mental agony has been caused to the flat owners as each and every owner has put in tremendous efforts in the customization of their house with the interiors befitting their preferences and taste. These customizations can only be appropriate for the current house and will not suit any other premises. The mental agony was amplified when they had to remove these interiors at a cost and give it away as scrap, incurring a huge loss for which the builder is solely responsible.
From the month of August 2024, the builder has resorted to pre-demolition activities removing common area items and there is no parking available. The lifts had been dismantled and owners had to use the steps in the staircase.
Chennai Corporation has also accorded approval for the demolition activity, vide their letter dated Sep 19th 2024.
Hence, it is now unsafe and also impractical for all 465 owners to go to their flats for getting their interiors photographed and videographed.
Considering the above submissions, we request the Hon. Committee to come up with a generic formula for the compensation of interiors. We have requested 15 percent of the total flat cost to be provided by the builder for the interior losses, which may kindly be considered by the Hon. Committee.
