The Issue
Currently, due to the coronavirus, social distancing protocols and shelter-in-place orders, residents at the Crescent Village and Verona apartment communities in San Jose are unable to use amenities such as fitness centers, pools, lounges, game rooms etc.
The rent required to pay by the residents of these communities reflects these amenities being available to use by residents, and as such is higher than the rent requested by other communities where such amenities are not available. The availability of these amenities was assumed while signing the lease agreements between residents and the landlord.
We thus request that the landlord, River Oaks San Jose Group LLC, or any other entity which is in control of the rent, offer a reasonable discount in the rent requested to pay by the residents as long as the amenities are unusable by the residents.
A reasonable discount amount could be estimated by comparing rent at similar apartment communities which do not have all or most of these amenities.
To clarify, once the amenities are provided and usable again, and no restrictions are in place preventing the amenities from being used by the residents, the rent would return to the original amount mentioned in the residents' lease agreements.
