⚠️ Public Trust Is Broken — The District Attorney Must Be Investigated
District attorneys are entrusted with one of the most powerful roles in our justice system. They are responsible for ensuring that no one is above the law — including themselves!
But in Westmoreland County, serious concerns have been raised about whether District Attorney Nicole Ziccarelli has used her office to avoid accountability and shield others from prosecution. The public deserves to know the truth.
 
🚗 THE CRASH SHE NEVER ANSWERED FOR
On the night of December 18, 2023, Ziccarelli was involved in a crash on Route 66 near Greensburg, PA, while driving a county-issued vehicle. The car sustained major damage. The incident was confirmed by state police, and the crash was publicly reported by the Tribune-Review and WTAE.
What shocked the public was not just the crash — but what happened next:
Ziccarelli did not call 911.
She left the scene and was not available to investigators for more than 24 hours.
No DUI test was conducted due to the delay.
The entire matter was handled internally, with no public discipline, explanation, or consequences.
For any other citizen, this would have triggered criminal charges. But for the DA? Silence.
 
🧒 WHY WAS A CONSTABLE ACCUSED OF SEXUAL ASSAULT NEVER CHARGED?
In another troubling case, multiple sexual misconduct allegations were brought against Constable Jesse Smith, including from a woman who said he assaulted her during a court-related transport. The allegations were so serious that state police investigated and referred the case to the DA’s office for possible charges.
But according to public reporting, DA Ziccarelli’s office declined to prosecute, citing “insufficient evidence” — despite multiple victims and law enforcement’s referral. No charges were filed. The public received no detailed explanation. Smith remained free.
Survivors and their advocates have expressed outrage and fear. What message does this send to victims who come forward?

While no formal findings of misconduct have been issued, these incidents have raised alarming questions:
Why did the DA not face the same treatment as a private citizen in the crash?
Why were serious allegations against a law enforcement officer dismissed without full transparency?
Why does the community feel silenced, ignored, and unprotected?
 
⚖️ IT’S TIME FOR ACCOUNTABILITY
When powerful officials operate behind closed doors and escape scrutiny, our justice system suffers. When survivors and citizens lose trust in the DA, we are all at risk.
This petition does not make assumptions — it calls for truth. And truth requires investigation.
 
🛑 WHAT WE DEMAND:
A full and independent investigation into DA Ziccarelli’s December 2023 crash and the handling of the Jesse Smith case and other questionable cases.
Public transparency from the DA’s office regarding all findings.
Review by the Pennsylvania Disciplinary Board into potential ethics or conduct violations.
If wrongdoing is confirmed, resignation or formal removal from office.
Oversight by the U.S. DOJ Civil Rights Division for patterns of unequal application of justice.
 
🗣️ THE SYSTEM SHOULD PROTECT PEOPLE, NOT POWER
No public servant should be above accountability. When a district attorney walks away from a wrecked government vehicle with no charges and refuses to prosecute credible allegations against law enforcement and others — the system is broken.
