Investigate and Pursue Removal of Fairfax County's Attorney Steve Descano

The Issue

Fairfax County families deserve to feel safe. Virginians deserve a justice system that applies the law fairly and consistently.

Serious concerns have been raised about decisions made by Fairfax Commonwealth’s Attorney Steve Descano in cases involving violent crime. There have been multiple situations where repeat offenders were released or had charges reduced, and later were accused of committing new violent crimes. These include cases involving murder, sexual offenses, and other serious charges.

There are also concerns about public statements indicating that certain laws would not be enforced if the prosecutor disagreed with them. Many Virginians believe prosecutors have a duty to enforce the laws passed by the legislature — not pick and choose which ones apply.

Prosecutors have significant discretion, and that responsibility must be exercised carefully. When decisions result in dangerous individuals being released back into the community, the public deserves answers. When families lose loved ones after an offender was previously released, communities understandably question whether more could have been done.

This is about public safety, transparency, and accountability.

Under Virginia law, an elected prosecutor cannot simply be fired. However, the law does allow for judicial review and possible removal if a court finds neglect of duty, misuse of office, or incompetence.

We call on Virginia Attorney General Jay Jones to conduct a thorough, independent review of the Fairfax Commonwealth’s Attorney’s handling of violent felony cases. If the evidence shows that legal standards for removal have been met, we urge him to support judicial proceedings as provided under Virginia law.

Virginians deserve confidence that the justice system protects communities, respects victims, and enforces the law equally for everyone.
