Opt out of Instagram’s Automatic Arbitration

The Issue

Instagram and its parent company Facebook have always been entirely digital platforms for their users, and yet they have designed a Terms of Use which require users who choose to opt out of mandatory arbitration to physically mail any opt out requests and ensure receipt prior to January 20th, 2020. The clear and deliberate phrasing of their terms is designed to decrease the likelihood their user base will opt out. Not opting out automatically waives users’ rights for a jury in any future court proceedings, making their only option arbitration managed by Facebook themselves.

We believe that for platforms which are entirely digital, the option to digitally opt out should be included for the user. We hope this petition draws attention to Instagram and Facebook to voice our frustration over this mailing requirement. A burdensome requirement to manage when we are already busy trying to manage the complex issues presented by Covid-19 this year.

Through this petition we are also providing an electronic mailing service to submit your opt out request to Instagram. We are asking for a minimum contribution of at least $3.00. We will submit the information that Instagram’s Terms of Use demands and manage the mailing and confirmation of your opt out to Instagram so it has the least impact on your time and efforts. 

This mailing service option will expire January 15th, 2020 at 3:00 AM Pacific Time to ensure your opt out request is delivered timely as currently required by Instagram's Terms of Use. Instagram’s intentionally complicated Terms of Use attempts to eliminate user’s rights and prevent Instagram’s accountability for the future. We hope to foster change through this grassroots movement. Will you join us?
