On 1st of June 2022, my dogs were taken and impounded for attacks they didn't commit.

 

 

On seizing my dogs, the inspector said I could see them every day and that they were only being taken so he knew where they were.  

 

 

 

 

The council allege my dogs were involved in attacks on 22 May 22.  Including that they also bit a woman.

Its a very serious allegation to make that someone's dog bit you. 

BUT........... There is no penalty for lying. 

Lying may be unethical but unless it's under oath it's not illegal so her lie is not punishable by purjury so I thought until a good friend sent me a link to :

 I found Video Proof this woman lied. !!!!!

Posted to her partners Facebook page was a video of the victim carrying a birthday cake at a party with short sleeves on with clear image showing no injury!!!!!! The alleged attack was said to have occurred at 10am on the 22 May 2022, the footage from the birthday party showing the alleged victim without the injuries has a football game playing in the background.  Channel 7 Live and Free, Round 7 SANFL Port Adelaide v West Adelaide Match at Loxton Oval. First bounce was at 2:05pm 22 May 2022.  This was the Russel Ebert Tribute Match. This footage confirms that the video is from 3 hours after she said she was attacked.

 

 

 

 

 

 

 

 

 

 

 

 

THIS IS PROOF THIS ATTACK NEVER OCCURED, I BELIEVE THIS STORY WAS FABRICATED BY THE COUNCIL TO HIDE THE REAL REASON MY DOGS WERE TAKEN................................

 

 

 

THE REAL REASON?

It appears my dogs are being used as collateral. The Council needed an opportunity to subpoena certain documents held by another government agency relating to a particular event, on a particular day, at a particular place, The opportunity to subpoena this information could only arise in either a court or tribunal exercising its powers to issue a subpoena.

Creating a make-believe attack and issuing destruction orders alleging the attacks occurred the same day and same place as the same particular event which the documents they are trying to access relate to.  Once the owners appeal the destruction order the matter gets reviewed in SACAT (tribunal).

The documents they wanted to access related to an event in July 2021. They couldn't issue destruction orders for an attack that occurred some 18mths beforehand, so they fabricated an attack which they allege occurred  on 22 May 2022 This allowed them to issue the destruction orders which were then appealed in SACAT

THEN.......... 

Once at SACAT - the council added the second attack which they allege occurred in July 2021, the exact same day and place as the event relating to the documents they were trying to access.

It became clear to me what this was all about when the council hired two lawyers and a Barrister against unrepresented individuals and then used the power of SACAT to issue a subpoena to the commissioner of police for SAPOL documents that had absolutely nothing to do with dogs.

 It's immoral, unfair and just plain cruel what is happening. Using innocent dogs as collateral to access documentation

My dogs have been impounded for 12 mths.  I have proven it was all fabricated. but they still won't return my dogs. 

SACAT sided with the council in the most soul-destroying experiences of my life to destroy my dogs.  NO evidence, no reasons. It was just shocking what goes on in SACAT. Don't ever think you will get a fair hearing, you wont.  I believe SACAT is just a rubber stamp for councils and govt. departments to do what they want..

I still have some hope, but the Only thing keeping my dogs alive is a  interim restraining order from the Magistrates court not to destroy Dakota and Charlie.

I don't know how long i can keep the order on the council solicitors have applied to have it removed so could be only day or weeks.

Its uncharted territory. It hasn't been done before. From SACAT back into the courts. I don't know how this is going to turn out. All i know is I can't give up trying to save the most important thing in the world to me. My soul mates Dakota and Charlie.

What can you do.... Let the Campbelltown Council know this is not ok. And that Dakota and Charlie need to go home.
