Impeach Hamilton County Sheriff Dennis Quakenbush
The Issue
On July 23rd, Hamilton County Sheriff, Dennis Quakenbush, issued a statement that his department will not be enforcing Governor Holcomb's executive order which will require the use of face coverings statewide beginning on July 27th to reduce the spread of this global pandemic we are facing.
He further justified this decision by saying that the executive order was unconstitutional, and is simply upholding his oath. However, according to the American Bar Association, 200 years of Supreme Court precedent, as well as the Tenth Amendment of the U.S. Constitution, both grant the States the authority to "take public health emergency actions" such as a statewide mask mandate, "to control the spread of dangerous diseases."
We cannot allow this Sheriff to endanger the lives of Hoosiers with his negligence and refusal to perform his job.
The Indiana Constitution (IC 5-8-1-21 to 37 and IC 5-8-2-1) tells us that a Sheriff can be impeached on the grounds of: "refusal or neglect to perform official duties."
Governor Eric Holcomb gave Sheriff Dennis Quakenbush a duty, and he is refusing to uphold the responsibilities of his position.
Even worse, Hamilton County is notorious for racial profiling, which negatively affects people of color (POC). In other words, when it comes to things that hurt POC, like traffic stops, this department tends to over-police. But, when it comes to an executive order intended to reduce the spread of COVID-19, a disease which disproportionately affects people of color, this department chooses instead to under-police.
