Implement Statutory Minimum Sentences for Rape

The Issue

I cannot believe that rapists can go free under current law. The judicial system must be reformed to ensure that those guilty of committing rape receive sentences that reflect the gravity of their crimes. It is vital that we establish mandatory minimum sentences for those convicted of rape, covering all types and circumstances, including historical offences.

This proposal is simple yet essential. We propose statutory minimum sentences based on the current three categories of harm, ensuring justice is consistently served. The suggested minimum sentences are as follows: 5 years, 10 years, and 10 to life imprisonment, depending on the severity and circumstances of the crime. These minimums are crucial to guarantee that justice is neither lenient nor discretionary.

Additionally, current practices allow for significant sentence reductions for guilty pleas, which can inadvertently undermine the severity of the crime. We propose a cap on sentence reduction for guilty pleas, allowing no more than a 10%-20% reduction. This ensures that the punishment better fits the crime, and acts as a strong deterrent against such heinous acts.

Rape survivors deserve justice and the assurance that their experiences are not minimised by the legal outcomes for perpetrators. By implementing these statutory minimum sentences, we take a critical step towards holding perpetrators accountable and providing solace to survivors, knowing that justice will be served more equitably.
