Implement Equal Zoning Laws for Home-Based Care Facilities in Canada

The Issue

As a mother to two autistic young men, I have firsthand experience of the challenges that arise after high school. This personal journey led me to purchase a home with the intention of caring for special needs adults. However, I was informed by the Town of Coburg that this is against their zoning by-law, as it would be considered a group home or an institution.

We, the undersigned, respectfully submit this petition to address an inequality in zoning laws governing home-based care facilities in Canada. Specifically, we seek parity between regulations governing foster homes for children and those governing home-based care facilities for seniors or special needs adults.

Currently, in Canada, individuals who wish to operate a home-based care business, providing accommodation and support for senior citizens or adults with special needs, are required to adhere to stringent zoning bylaws. These regulations often impose significant restrictions and bureaucratic hurdles, making it challenging for caregivers to provide essential services to those in need within their communities.

In contrast, foster homes, which provide similar levels of care and support but for children, do not face the same zoning requirements. This discrepancy is not only unjust but also undermines the principle of equality and fairness in our regulatory framework.

We believe that the care and support provided to vulnerable individuals, whether they are seniors, children or special need adults, should be subject to the same zoning regulations. Just as foster homes play a crucial role in providing safe and nurturing environments for children in need, home-based care facilities for seniors and adults with special needs fulfill a vital societal function by ensuring their well-being and quality of life.

By treating these two types of care facilities equally under zoning laws, we can:

Ensure equitable access to essential care services for seniors and adults with special needs across communities.
Streamline regulatory processes, reducing administrative burdens for caregivers and enabling them to focus more on providing high-quality care.
Promote inclusivity and compassion within our society, recognizing the value and dignity of all individuals regardless of age or ability.
Therefore, we urge the legislative authorities of Canada to review and amend existing zoning laws to eliminate the disparities between regulations governing foster homes and those governing home-based care facilities for seniors and special needs adults. We call for the implementation of fair and consistent zoning requirements that reflect the equal importance of both types of care facilities in our communities.
