The Issue
As a Family Court District Judge, one of the most important fabrics within the Judicial system is maintaining integrity, public confidence and fairness. Noticeably, instead when a judge acts with clear Impartiality, prejudice and bias with a particular party in a Family Court, there must be laws and guidelines in place to prevent this misconduct and abuse. Right? But there's not. "The best interest of the child" is an anchored statement in Family Courts when handing down judgements involving custody matters.
That statement should be replaced with "Personal Relationships" and Conflict of Interest matters most in Family Courts Judicial System.
Judge Lyndsey Wynne has destroyed the relationship between a father (Black) and an innocent (4 year old) daughter by allowing his attorneys to withdraw on him minutes before their high impact custody hearing, then denying him the opportunity to seek additional counsel and testify. Furthermore, she granted every request by Opposing Counsel and her client which is also a DFPS (Caucasian CPS agent) that works along the side of the Family Court Judges and Attorneys in Collin County.
In addition Judge Lyndsey Wynne granted every single request by opposing counsel and her colleague. Attorney's fees and psychological evaluation. Judge Lyndsey Wynne terminated the fathers possession and access to seeing his daughter without any history of concern, cause for concern by the child's pediatrician, cause for concern with local authorities.
To date June 29th 2022, the father has not seen his daughter since October 1, 2020 when she was three and adored her father. This relationship was maliciously interrupted by a prejudice judge with an extreme personal bias against the father along with a concerning conflict of interest relationship with the mother of the matter that also works for DFPS. Also, father is still responsible for paying child support for the child despite Judge Lyndsey Wynne terminating his possession periods with the child on October of 2020.
To make matters worse, Judge Wynne previously allowed the mother to violate court orders and not only deny visitation but withhold the child for nearly four months without any communication or known whereabouts violating their court decree. Father was forced to hire an attorney to gain his court ordered possession periods, during this time the fathers attorneys filed multiple restraining orders and requested emergency hearings to bring before Judge Wynne. Noticeably, Judge Wynne denied every motion request filed by the fathers attorney despite the child being missing and held without any contact.
Father had Extended SPO Thursdays 6-8 and 1/3/5 Weekends.
Ironically, Judge Lyndsey Wynne attempted to assign a second judge to review this unjust and coincidentally it was Judge Mark Rusch formerly of District Court 401 in Collin County. A petition was filed against Judge Mark Rusch claiming that he wrongfully requested a mother to pay for medical support, attorneys fees and most noticeably a psychological evaluation. Indeed, the exact playbook that Judge Lyndsey Wynne handed down on the father.
Due to the misconduct, Impartiality and abuse of discretion by Judge Lyndsey Wynne has caused the father in excess of $210,000 since 2019 in defensive legal fees. This has impacted the father emotionally, his other kids from a previous marriage who had a great relationship with their sister that is now (4).
As we are a witness, in our society today unheard voices or concern and reason are muffled into the shadows of our society. However, action and public notice creates change and fairness for all.
We ask all victims of discrimination, bias, impartiality, prejudice.
To speak up.
Speak up for our innocent kids that need a civil co-parenting community as well as speak up for equality, fairness, and sanctioning judges that feel as though they are above the law, and no longer have the "best interest of the child" Yet instead make irrational bias judgments based off of emotional hearsay and relationships.
