Hello to everyone who has signed the petition for Javier!

It has been awhile since we have provided an update in his case. Javier's next appointment at DHS/ICE in Miramar under his OSUP (Order of Supervision) is in just a couple weeks - on July 27th. It is our hope that DHS/ICE will be willing to cancel and/or reschedule this appointment since I will be recovering from surgery, donating a kidney to my sister-in-law just prior to this appointment. Javier has been on this OSUP program for approximately seven (7) years now, and has duly complied with ALL the requirements and conditions during this entire period of time. 

As many are aware, the new Biden Administration has issued a new policy memo for guidance to DHS/ICE in the context of prioritizing deportations and removals from the United States. Javier clearly does not fall within ANY such priority, as set forth in this memo, dated May 27th. As such, we are respectfully requesting that DHS/ICE exercise its inherent and clear discretion to issue Javier a Notice to Appear (NTA), which would potentially end this perpetual and endless OSUP program. More importantly, this would finally give Javier a chance to go before an Immigration Judge in Miami and seek cancellation of removal, having lived in the U.S. for some 20 years and having his U.S. citizen wife & 3 U.S. citizen daughters, who would ALL face extreme hardship if he was to be deported/removed from the USA. 

It is our hope that everyone can PLEASE SHARE this petition, spread the word and the message of keeping this family together here in the US. If we can reach 150k signed petitions, this will be 1 of the TOP SIGNED PETITIONS on CHANGE.ORG, a huge accomplishment! More importantly for our case, we will be able to present these petitions to DHS/ICE in support of the 2 goals above - getting Javier off this OSUP program, and hopefully convincing DHS/ICE to issue Javier an NTA so he can finally have his day in Court with his family in a very deserving and compelling case.
