The Issue
Right now, insurance companies in Illinois are sitting on millions of dollars that were specifically set aside for abortion care — and the people who need that care most can't access a single dollar of it.
House Bill 5408 would change that. It would require insurers to report how much money they've collected in these segregated abortion funds and transfer unused balances to a new state Abortion Access Fund. That money would then go directly to providers as grants — helping uninsured and underinsured people get the care they need.
This isn't new money. It's not taxpayer dollars. It's funds that insurance companies already collected from enrollees under the Affordable Care Act — money that was always meant to cover abortion care. It's just been sitting there, unused, while people in Illinois and across the country struggle to afford the care they're legally entitled to.
Illinois has become a lifeline for the nation. In 2025 alone, clinicians here provided more than 87,000 abortions — more than any other state in the Midwest — including thousands of people who had nowhere else to turn after abortion bans took hold in their home states. Our providers are carrying enormous demand. They need sustainable funding to keep up.
Similar laws have already passed in California and Maryland. Illinois should be next.
The insurance industry is lobbying against this bill, claiming regulatory uncertainty. But there's nothing uncertain about people being unable to afford care that is legal in this state. The uncertainty is falling on patients — not insurers.
We're calling on the Illinois General Assembly and Governor JB Pritzker to pass HB 5408 and ensure that abortion access in Illinois isn't just legal — it's real and reachable for everyone, regardless of what they can afford.
