I Support AL HB 453 (Rep. J. Fidler): Access to Breast Reconstruction

The Issue

The Core Problem
Many women in Alabama cannot obtain the breast reconstructive surgery they are legally entitled to under federal law. While the Women’s Health and Cancer Rights Act (WHCRA) has required coverage for breast reconstruction after mastectomy since 1998, that protection is not consistently enforced in Alabama. As a result, insurers often create barriers that delay, limit, or effectively deny access to care.

Key Facts

  • Breast reconstruction after mastectomy is not cosmetic—it is medically necessary cancer care required under federal law
  • Access in Alabama is failing
  • Despite the federal mandate, many Alabama patients cannot obtain reconstruction in-network or in-state.
  • Insurer practices create barriers to care
  • What Patients and Physicians are Experiencing:
    • Delays in authorization and scheduling
    • Coverage denials or repeated appeals
    • Inadequate provider networks
    • Reimbursement levels and other contract provisions that discourage surgeon participation
    • Restrictions on referrals to qualified out-of-network specialists
    • Highly specialized breast reconstruction procedures are offered by a small number of surgeons in Alabama, and insurer contracting practices further reduce patient access
    • Patients are forced into harmful choices
    • Many women must:
      • Travel out of state for reconstruction
      • Wait months or years after mastectomy
      • Go without reconstruction

Why This Matters

  1. Lack of access to medically necessary reconstruction undermines patient dignity, mental health, and physical recovery
  2. Federal rights are meaningless if patients cannot actually obtain the covered care
  3. Alabama women should not face greater barriers than patients in other states

What HB 453 Does

HB 453 strengthens Alabama law to ensure that breast reconstruction coverage promised under federal law is real and accessible in practice.

The bill is intended to:

  • Ensure patients can actually obtain covered reconstruction services
  • Requires that patients are informed of all their options
  • Address insurer practices that delay or block access
  • Improve access to qualified reconstructive surgeons
  • Align Alabama enforcement with federal requirements
  • Protect patients during a vulnerable stage of cancer treatment

The Bottom Line

HB 453 is about access, not mandates. HB 453 ensures Alabama women can actually receive the care they are entitled to—without unnecessary barriers, delays, or denials.
