The 18th Judicial system has violated my rights and continue to do so in child custody court. I am not getting a fair trial. I’ve hired a lawyer but still can’t seem to get anywhere with my case. The judge wouldn't make any decision because he didn't want to rule in my favor. My case has been ongoing since 2019 when my child's father kidnapped my son from a football game at the south YMCA and made statements that he was suicidal and refused to return my child back home. I made a police report and filed a PFA against my child's father when the situation occurred which was granted for both me and my son. Once my child returned home there were some very detrimental things that happened or took place while he was with his dad. His Dad let him hold a big gun which my son described as a (AK47) also that he made statements that he would use it on anybody that tried to come get him. Our son has been in therapy since then and continues now from the trauma it caused. During that time the visit was stopped due to the PFA.  At that point both me and my child's father made a motion for custody change we had joint custody. My child's father wanted sole custody of our son because he doesn't like my sexuality and doesn’t think two women can raise a boy. The Judge has also made/said inappropriate statements, comments about me personally “like I'm just mad” also he has used scare tactic's by saying he would throw me in jail as if I'm some kind of criminal for trying to protect my child's life. So, I hired a private investigator to speak on my son's behalf. Before it was presented to the Judge my lawyer asked that it be kept confidential due to the sensible information and somehow it got released to the public putting my family and I in danger. Recently there was a massive shooting that happened this year on May 24th, 2022, in Uvalde Texas where 20 kids under the age 10 were murdered in cold blood. Also, you may or may not know there was a convention hosted May 27th- 29th for NRA known as NATIONAL RIFILE ASSOICATION. Journey continues as a board member of the NRA and attended the convention in Texas. Judge Philip Journey was interviewed by CNN where he made a comment about the massive shooting, Journey was asked why they still hosted it only a couple days after this heroic tragedy? Judge Journey's comment was that the NRA DID NOT PULL THE TRIGGER! This is not the comment in my opinion that as a Judge especially in family law and serving the community should be making about the death of 20 innocent children. That was another reason I asked the judge to recuse himself from my case because of the bias, discretion with the guns and my sexuality. My recusal was dismissed by Phillip Journey and never heard by a judge higher in command Journey stated I had failure to state a claim and was forced to continue on with hearings against my will. That forced my hand to file a lawsuit against the judge. During this time my lawyer put in another recusal based off the lawsuit I filed pro se against the judge. which was heard again by judge Phillip Journey where he refused again stating to my lawyer that he wasn’t going to get off my case that would be “excusing my behavior.” At that time my lawyer went to our chief in command Judge Goering chambers personally. whom stated that, that didn’t automatically disqualify a Judge from hearing a case in the state of Kansas. Since then, I've been in trial since January 3rd; the trial has currently ended March 3rd. The judge made his final ruling Friday. Making false allegations against me stating I alienated my child from his father making him a child in immediate danger that needed to be removed out of my home. He also put a non-contact order on me stating I cannot see him talk or text etc. which is really extreme seeing there was no testimony ever given proving these allegations. Then Judge Journey ordered me to get a psych evaluation by someone he referred, but not the father. Both me and my child's father and son had to get hair follicles ordered by the courts. The test came back father (positive) child (negative) and mother (inconclusive). So, then judge Journey ordered we take a UA in court I take delta 9 gummies for migraines and chronic pain my child's father admitted he smoke’s weed. The judge put me contempt of the court for my hair follicle coming back inconclusive which I had no control over. I have 3 contempt of courts that hold 6 months each 18 months total. While he suspended all of the father contempt's of courts for failure to pay his child support, parental kidnapping and failure to do his B.I.P assessment ect. Judge Journey will review my case in 90 days which he set June 20 which is almost 4 months. The judge ordered me to write a farewell letter to my son. When I stated I was never going to say goodbye to my son the judge took it out of context. Stating I was contempt of the court and order me 30days in the county jail. Then he demanded I stand up and give him an apology if I wanted to suspend the jail time. This Judge is clearly retaliating against me because I filed a lawsuit against him. There's no lawyer down here in Wichita, KS that will fight a judge in their same state. I'm a black woman being discriminated against for being LGBTQ and treated unfair in the 18th Judicial System and need HELP! I'm not getting the right to exercise my amendments; I know other people going through the same thing that I am that have the same lawyer and Judge.
