Dear Human rights supporters, activists, friends, and colleagues,

We are deeply concerned about the current state of human rights protection in Bangladesh.

As you know, Bangladesh has agreed to the United Nations Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment (UNCAT). It is very unfortunate that human rights violations by state and non-state actors have now become a regular occurrence in Bangladesh.

We, the citizens, have repeatedly experienced the oppression of such state non-state actors. Attempts are being made to control the non-communal section of society through legal and extra-judicial means. We have been living under either the threat of death or intimidation, force, manipulation. Such rights violation of rights continuing, and it has many faces.

We have noticed how radical, sectarian, and extremist religious groups have become powerful.  One of the main hallmarks of the politics of these communal extremist forces in and out of government is that they provide exemplary punishment to those who want to go beyond patriarchal control and want to exercise freedom of expression. Citizens' voices have been taken away by the Digital Security Act 2018 (2) by our government. The main victims of ‘violation of rights incidents’ are the progressive sections of society, women, intellectuals, and cultural professionals.

Now these state and non-state actors are working together against the human rights of citizens. They use various tools, the media, and the state apparatus, for example. The violent incident staged by the law enforcers in the home of popular film actress Porimoni is a continuation of this politics. It is happening with the help of the powerful communal groups and their supporters, within and outside the government, with legal and extrajudicial protection.

All these incidents are violations of constitutional rights, of international law to stop violence against women, and of human rights laws. At the international level, too, a number of issues related to Bangladesh, including environmental protection and human rights violations, remain unresolved.

This horrible state and non-state communal alliance are striking at the four great values ​​from which Bangladesh was born. We feel that we have continued to neglect these issues for too long and that the government, the country's armed forces, and individuals have a responsibility to play their own ethical role in changing this situation.

In this context, we are drawing the attention of the Government of Bangladesh, the international friend community to be with us to protect the rights of our fellow citizens.

We demand that the Government of Bangladesh:

-Takes immediate steps to implement the human rights clauses of the constitution since 1972.

-Takes steps to implement commitments made on human rights in the international arena.

-Takes immediate steps to address detained film actress Porimoni’s rights to have legal aid and secure her rights to fairness and justice.

-Releases immediately citizens detained and accused under the digital security Act 2018(2), for example, Jhumon Das and others, unconditionally.

-Ensures that the law enforcement functionaries refrain from any kind of violation of the laws of the country.

-Makes sure its functionaries refrain from using state organs, in a legal and or extrajudicial manner, in favor, of campaigns of the fundamentalist, communal forces, and moral Police.

-Takes steps to support an environment that allow citizens to nurture graceful values of freedom of expression and Human Rights.

প্রিয় মানবাধিকারে বিশ্বাসী সহকর্মী, সুহৃদ ও বন্ধুগণ,

আমরা বাংলাদেশের মানবাধিকার সুরক্ষার বর্তমান পরিস্থিতি বিষয়ে গভীর উদ্বেগ প্রকাশ করছি।

আপনারা জানেন বাংলাদেশ জাতিসংঘের ’নির্যাতন বিরোধী (ইউএনসিএটি) কনভেনশনে সম্মত হয়েছে এবং আইন-শৃঙ্ক্ষলা রক্ষায় ন্যায্যতা ও সাম্য নিশ্চিত করার অঙ্গীকার করেছে। এটি অত্যন্ত দুঃখজনক যে মানবাধিকার বিষয়ক এসব বিধিনিষেধ লঙ্ঘন বাংলাদেশে এখন নিয়মিত হয়ে উঠেছে।

আমরা নাগরিকগণ রাষ্ট্রযন্ত্রের নিপীড়নের অভিজ্ঞতা বারবার পেয়েছি। আইনী উপায়ে সমাজের অসাম্প্রদায়িক অংশকে নিয়ণ্ত্রণের চেষ্টা চলেছে। তাদের হত্যার হুমকীর ভেতর বাস করতে হয়েছে, হচ্ছে। ডিজিটাল সিকিউরিটি আইন ২০১৮(২) দ্বারা নাগরিকদের কণ্ঠস্বর কেড়ে নেয়া হয়েছে।

লক্ষ্য করুন, কিভাবে মৌলবাদী, সাম্প্রদায়িক ও চরমপন্থী ধর্মীয় গোষ্ঠী ক্ষমতাশালী হয়ে উঠেছে। সরকার ও সরকারের বাইরে থাকা এই সাম্প্রদায়িক চরমপন্থী শক্তির রাজনীতির একটি মূল লক্ষ্মণ হলো এরা পিতৃতান্ত্রিক নিয়ন্ত্রণের বাইরে যেতে চাওয়া ব্যক্তির জন্য দলবদ্ধভাবে দৃষ্টান্তমূলক শাস্তির ব্যবস্থা করে। হয় তাকে হত্যা করে বা নানাভাবে অপদস্ত করে। বিগত এক দশকে এরা দেশে অসংখ্য মানবাধিকার-লংঘনমূলক ঘটনা ঘটিয়েছে বা পেছন থেকে মদদ দিয়েছে। এসব ঘটনার মূল শিকার হচ্ছে সমাজের প্রগতিশীল অংশ, নারী, বুদ্ধিজীবি এবং সাংস্কৃতিক পেশাজীবিগণ।

এখন এরা পরস্পরের স্বার্থ অক্ষুন্ন রাখতে নাগরিকদের সবধরণের মানবাধিকারের বিরুদ্ধে একজোটে কাজ করছে। ব্যবহার করছে গণমাধ্যম এবং রাষ্টযন্ত্রের নানা হাতিয়ার। গতকয়েকদিনে সংস্কৃতি-কর্মী পরিমণি ও অন্যান্যদের বাড়িতে আইন-শৃঙ্ক্ষলাবাহিনীর যে তাণ্ডব দেখা গেছে তা এই রাজনীতিরই ধারাবাহিকতা। আইনী ও আইন-বহির্ভূত উপায়ে এই রাজনীতি সরকারী মদদেই ঘটছে।  

এই সমস্ত ঘটনা সাংবিধানিক অধিকারের লঙ্ঘন,  নারীর প্রতি হিংসা বন্ধে প্রণীত আন্তর্জাতিক আইন, এবং মানবাধিকার আইনের  লঙ্ঘন। আন্তর্জাতিক পর্যায়েও দেখা যাচ্ছে, পরিবেশ সুরক্ষা লঙ্ঘন এবং মানবাধিকার লঙ্ঘন সহ অন্যান্য বেশ কয়েকটি বাংলাদেশের সমস্যা অমীমাংসিত রয়ে গেছে। এই ভয়াবহ সাম্প্রদায়িক জোট যে  চারটি মূল্যবোধের ভিত্তি থেকে বাংলাদেশের জন্ম হয়েছিল, তাতেই আঘাত করছে । সরকার, দেশের সশস্ত্র বাহিনী, এবং ব্যক্তি নাগরিকগণ এ পরিস্থিতির পরিবর্তনে ইতিবাচক ভূমিকা রাখতে দায়বদ্ধ।

এ্ই পরিপ্রেক্ষিতে  আমরা বাঃলাদেশ সরকার, আন্তর্জাতিক বন্ধুমহলের দৃষ্টি আকর্ষণ করছি এবং সরকারের নিকট দাবী উত্থাপন করছি যে, অনতিবিলম্বে সরকারকে  :

-৭২ সাল থেকে সংবিধানে উল্লেখিত মানবাধিকার ধারাগুলো বাস্তবায়ন কোর পদক্ষেপ গ্রহণ করতে হবে।

-আন্তর্জাতিক পরিমণ্ডলে মানবাধিকার বিষয়ে দেয়া সরকারী প্রতিশ্রুতিগুলো বাস্তবায়ন করতে হবে।

-সাম্প্রতিক সময়ে আটককৃত চলচ্চিত্রশিল্পী পরিমণিকে ন্যায্য বিচার ও আইনী সহায়তা পাওয়ার সুযোগ দিতে হবে।তার ওপর যে অন্যায় চাপ সৃষ্টি করা হচ্ছে, যুক্তিহীন মিডিয়া ট্রায়াল ও পাবলিক শেমিং চলছে, আমরা তার তীব্র নিন্দা জানাই। এসব অনতিবিলম্বে বন্ধ করতে হবে।

-ডিজিটাল সিকিউরিটি আইন ২০১৮(২) এর অধীনে আটককৃত এবং অভিযুক্ত ঝুমন দাস ও অন্যান্য নাগরিকদের নিঃশর্ত মুক্তি দিতে হবে।

-আইন ও আইন বহির্ভূত উপায়ে সাম্প্রদায়িক শক্তির জোটকে সরকারী মদদ দেয়া বন্ধ করতে হবে।

·মৌলবাদী গোষ্ঠীর নানাবিধ প্রচারণায় রাষ্ট্রযন্ত্রের নানা অঙ্গ কাঠামোর ব্যবহার বন্ধ করতে হবে।
- বাক স্বাধীনতা লালন ও সমর্থনের পরিবেশ তৈরির সুনির্দিষ্ট পদক্ষেপ গ্রহণ করতে হবে।
