My name is Alexandra - I created this petition for my best friend and her family who are wrongfully evicted from the Thea Bowman Residence for Disabled Families by Catholic Charities, Amityville, Long Island, NY. Being disabled should not be crime!! 

BACKGROUND TO THIS HORROR:
THIS IS NOT A "NON-PAY" EVICTION - IT WAS A "HOLDOVER" EVICTION WHICH WAS ON THE COURT CALENDAR FOR ALMOST 3 YEARS (OVER 32 APPEARANCES). MS. THOMAS KEPT BEGGING FOR THE CASE TO GO TO TRIAL BECAUSE SHE KNOWS HER HUMAN RIGHTS HAVE BEEN VIOLATED UNDER THE ADA/504- INSTEAD HER ATTORNEYS (( NASSAU - SUFFOLK LAW SERVICES)) DROPPED HER STATING BASICALLY THERE WAS NOTHING MORE THEY COULD DO FOR HER AND THAT "NO JUDGE WOULD GIVE HER ANY BETTER" THAN WHAT WAS IN THE STIPULATION THEY HAD PRESENTED HER OVER TWO YEARS INTO THE CASE. INSTEAD OF PROTECTING HER RIGHTS UNDER THE ADA/504 - THEY TRIED TO BULLY HER INTO SIGNING A STIPULATION AS PART AND PARCEL TO EVICTION VVHEN THEY SHOULD HAVE PROTECTED HER RIGHTS TO A REASONABLE ACCOMMODATION VVHICH NEVER SHOULD HAVE INITIATED ANY LEASE VIOLATION OR EVICTION PROCEEDING - THE ENTIRE SUFFOLK COUNTY JUDICIARY FOLLOVVED THEIR LEAD LIKE IT IS COMMONPLACE TO DO THIS !!!!!! HER RIGHTS NEVER SHOULD HAVE BEEN VACUUMED UP INTO AN EVICTION PROCEEDING - PLEASE HELPPPPPPPPPPP!!!!!!!

MS. THOMAS MAINTAINED THAT HER REQUEST FOR THE "REASONABLE ACCOMMODATION" UNDER THE ADA/ 504 TO HAVE AN AIDE OVERNIGHT SHOULD NEVER HAVE INITIATED AN EVICTION AS CATHOLIC CHARITIES WAS WORKING ON EVERYTHING WITH HER AND THEN ONE DAY OUT OF THE CLEAR BLUE THEY JUST SLAPPED HER WITH A 30 DAY NOTICE - KNOWING HER DOCTOR STATED THAT SHE NEEDED AN AIDE RIGHT AWAY OR SHE COULD GO INTO SPONTANEOUS CHF DUE TO MASSIVE FLUID SHIFTS FROM HER UNTREATED LYMPHEDEMA. THE STAFF & RESIDENTS IN HER BUILDING WERE SHOCKED!!!

TO THIS DAY THE RESIDENTS, SOME BUILDING STAFF & FRIENDS CANNOT WRAP THEIR HEADS AROUND ALL OF IT BECAUSE THIS FAMILY HELPS EVERYONE IN THE BUILDING WITH THE CHARITY THEY CO-FOUNDED   .....FROM FOOD TO MEDICAL EQUIPMENT - RIDES TO THE DOCTOR & PROSTHETIC FITTINGS - VISITS IN THE HOSPITAL - RIDES HOME FROM THE HOSPITAL - SPECIAL DAYS PLANNED FOR VETERANS............ THEY ARE DOING THIS ALL 100% VOLUNTEER!!! 30 + LETTERS WRITTEN BY RESIDENTS AND FRIENDS & LOCAL PROMINENT BUSINESS PEOPLE AS WELL AS STATESMEN ON THEIR BEHALF AND NO RESPONSE FROM THE CEO OF CATHOLIC CHARITIES - LAURA CASSELL OR BISHOP BARRES!!!!! FOR GOD SAKE AT LEAST SPEAK TO THE FAMILY AND HEAR THEM OUT!!!! HOW IS THIS WHAT JESUS WOULD DO!!!??? WWJD????

UPDATE - On 10/3/2018 - The DAY - FIVE Suffolk County Sheriffs came to REMOVE this KIND woman from her hospital bed and this WONDERFUL family from their Section 811 PRAC Housing for Disabled people with VERY LOW INCOME. The Suffolk County HUMAN RIGHTS COMMISSION MADE THE DECISION TO GIVE CATHOLIC CHARITIES TWO MORE WEEKS TO RESPOND TO THE FORMAL COMPLAINT - EVEN after TEN DAYS following certified mail and countless MONTHS of CALLING THE CEO - "LAURA CASSELL"  as well as their ATTORNEYS - AND GETTING ZERO RESPONSE!!!!

ON 9/27/2018 - THE HUMAN RIGHTS COMMISSION PLEAD IN COURT TO GET A STAY ON THE EVICTION FOR OUR FRIENDS FAMILY. IT WAS DENIED BY THE SUPREME COURT ALSO. ((((( THIS HAS TO STOP!!!! ))) The LAW is being BROKEN by Catholic Charities and not only does NO ONE CARE - No one will take a STAND in the judicial system!!!! Instead they punish this woman and her family!!! She will surely die from the stress of it all - the aneurysm and PRES syndrome isn't enough for them. This is TRULY INSANE!

THE HUMAN RIGHTS COMMISSION FILED A FORMAL COMPLAINT AGAINST CATHOLIC CHARITIES - BUT THEY ARE ALREADY ON THE SUFFOLK SHERIFFS LIST FOR EVICTION!!! PLEASE HELP!!!

********* BEFORE THEY WERE EVICTED:
The FAMILY father met with BISHOP BARRES in the parking lot of the RVC Diocese and Bishop Barres said he would look into everything and get back to them and he NEVER DID!!!! The family has BEGGED to get an audience with him so that he could know their side of what is happening and they were told NO NO NO NO NO 100 times by Diocesan Staff. 
In desperation the family after calling and calling Catholic Charities went directly to the office in Hicksville and were told by the receptionist "HOW DARE YOU COME HERE AND ASK TO THE THE C.E.O. WITHOUT AN APPOINTMENT" meanwhile NO ONE would answer them for months!!!! NOT ONE person from Catholic Charities EVER approached the family to help hear their plight personally. Even the Catholic Charities lawyers SPELLMANLAW.COM will NOT speak with anyone!! NOT EVEN THE HUMAN RIGHTS COMMISSION!!!

^^^^^CATHOLIC CHARITIES KNOWS this woman is unable to get to court as they have a camera DIRECTLY POINTED AT HER DOOR 24/7 365 and she has NOT left the apt in the past two years that she has been VERY ILL unless to go to the hospital!!! SHE DIDN'T MAKE HER OWN CHILD'S 5TH GRADE GRADUATION!!!!

                   

********THEY HAVE *****NO MERITORIOUS GROUNDS TO STAND ON AT ALL OR IT WOULDN'T HAVE BEEN PUT ON THE CALENDAR 32 times in more than TWO and A HALF years!!!! They WERE GRANTED A JUDGEMENT BY DEFAULT when Ms. Thomas COULD NOT APPEAR IN COURT.!! At the time doctors didn't know exactly what was causing the severity of her symptoms but it turned out A FEW WEEKS LATER to be PRES syndrome which includes edema on the brain - encephalopathy and a small brain aneurysm. Ms. Thomas also suffers from MANY co - occurring diagnoses including uncontrollable High Blood Pressure UNDER STRESS as she is being investigated for a SUSPECTED PHEOCHROMOCYTOMA!!!!
When the SUFFOLK COUNTY SHERIFF served her papers bedside her pressure went from 126/66 to 234/150  (((( way more than stroke volume)))) - the Sheriff asked "Do you want to go to the hospital" ?????

********Ms. Thomas sent her Aide with a WRITTEN REQUEST FOR AN Adjournment or a REMOTE ACCOMMODATION TO APPEAR at the last hearing. Judge JAMES FLANAGAN told the AIDE, "YOU are NOT an ATTORNEY" and he raised his voice telling the aide basically "DO NOT SPEAK AGAIN IN MY COURT AND DO NOT HAND ME ANY PAPERS".  A remote accommodation should have been granted ,but it never happened through our judicial system and it is THE LAW TO ENSURE ACCESS!!!!

******** The NYSUCS judicial ADA ACCESS TO JUSTICE GUIDE directs the judges to ENSURE equal ACCESS FOR ALL even if it means a REMOTE ACCOMMODATION.!!!!!.THIS WAS ALSO IGNORED !!!!!!!!!  The family was told by the ADA Liaison that this was a transferred Judge and that HE NEVER orders REMOTE ACCOMMODATION and that the 2nd District Court has "REALLY" "never" HAD TO PROVIDE ONE??????????????!!!!!!!!

Remote accommodation was not granted by our judicial system and it is the law. The NYUCS judicial guide directs the judges to ENSURE equal ACCESS FOR ALL -THIS WAS IGNORED !!!!!!!!! Long Island is not being provided the same equal access as others counties in NY.! We need guardian ad litems here on LI like they have in all the other NY CITY Counties !!! How is this a UNIFIED COURT SYSTEM??

CLEARLY JUDGE JAMES FLANAGAN JUST WANTED THIS CASE OFF HIS CALENDAR AND HE DID NOT CARE AT ALL WHAT IT WOULD DO TO THIS WONDERFUL FAMILY!!!!!!! DEFAULT GRANTED STATING "NO LEGALLY COGNIZABLE GROUND FOR THE REQUESTED RELIEF HAS BEEN DEMONSTRATED"................................WHATTTTTTTT??? The court has been aware for almost three years of Ms. Thomas condition as she was unable to make ALLLLLLLLLLLLLLLLLL 32 APPEARANCES!!!!! 

CRIMINALS ARE ARRAIGNED BY JUDGES NEXT TO THEIR HOSPITAL BEDS - SO IN ESSENCE DISABLED PEOPLE ARE WORTH LESS??!!!!!

************ Not being able to get to a courtroom to represent yourself  BECAUSE YOU ARE SICK should not end in eviction,especially when the court did NOT provide equal access to justice!!!  Terris civil AND HUMAN rights were violated and she is being discriminated against for being disabled !! The ADA law is being ignored by Catholic Charities as well as the NYUCS!!  The NY justice system and Catholic Charities are NOT FOLLOWING THE LAW !!!! 

                       A reasonable accommodation was requested and should have been granted immediately due to the fact that Ms. Thomas could have gone into CONGESTIVE HEART FAILURE and also suffers from MALIGNANT HYPERTENSION when UNDER STRESS WHICH CAN IMMEDIATELY BE FATAL!! She also has many OTHER disorders but Catholic Charities delayed this over 2 years with this court proceeding which NEVER should be brought about. THE ONLY LEASE VIOLATION ON THE CASE READS " YOU HAVE SOMEONE LIVING IN THE APARTMENT WHO DOES NOT BELONG".............AND NOTHING ELSE.........................WHAAAAAAAAAAAAAAAAAAAAAAAT???? 

What has this family done that WARRANTS EVICTION!!!??? The family has EMAIL PROOF that Catholic Charities was working with them all along and then one day SLAPPED a 30 day notice to evict!!!!!!!!.  
Catholic Charities is NOT following the law .Reasonable Accommodations should be made for the disabled !

          Many letters (35 to date) have been written on her behalf to save her and her family's housing BY THE OTHER RESIDENTS IN HER BUILDING, FRIENDS and PROMINENT MEMBERS OF THE COMMUNITY TO INCLUDE SENATORS AND CONGRESSPEOPLE!!!. Please contact Catholic Charities and beg them to help this family stay in stable housing.
