Regardless of the increasing publicity and reported incidents of animals suffering or, worse, dying from this act, why do people still fail to realise it is wrong, careless and cruel to leave any animal in a parked vehicle even with the windows down or in the shade?Our pets rely on us as to keep them cool, and safe. In a parked vehicle, temperatures can and do still reach a fatal high. Unlike humans, dogs do not have the ability to sweat and cool down; they pant and lose heat through their paws. This cooling system however has little efficiency in these baking conditions.75 degrees outside can reach over 90 degrees in a matter of minutes. Allow 30 minutes to tick by and the temperature has increased to 110 degrees. Would you be comfortable sitting in those temperatures with no ability to escape? Leaving the window open has LITTLE benefit to the inside temperature.Currently, there is little action a concerned bystander can do without being liable for criminal damage - how ironic? Breaking the imprisonment of this cruel and dangerous scenario holds more illegality than the conditions the animal has been intentionally placed in. The police advise to await their presence, as it is illegal to cause criminal damage to assist the animal to escape its oven, unless there is reasonable belief the owner of that property would agree (why would they agree - they intentionally placed them there?) Instead, we as the concerned public have to await the return of the vehicle’s owner or await Police presence. The time bomb is now ticking, every second counts as the temperature rises and the animal is placed in an increasingly dangerous temperature with no escape and no respite.
When the police arrive, what powers of prosecution do they hold? None..... NONE!! There is currently NO defined Law to state this is a breach under The Animal Welfare Act 2006 - THIS NEEDS TO CHANGE. THE POLICE NEED DEFINED LAWS AND A REASONABLE PERSON CRITERIA AND THESE IRRESPONSIBLE PET OWNERS NEED TO UNDERSTAND THERE ARE LEGAL CONSEQUENCES FOR THIS FAILURE TO CARE APPROPRIATELY FOR THEIR PET.
This loophole is causing uncertainty for the Police to deal with this issue and one could suggest even their reaction time to attend - the animal's comfort is naturally of their concern but by definition, with no criminal act occurring, it is a pointless battle to reduce criminally void activity.
The current Laws relating to the welfare of animals need to change; we would like to see a change to the Animal Welfare Act 2006 to make it illegal to cause unnecessary suffering to any animal through leaving it unattended in a hot vehicle, long enough to result in any level of discomfort to that animal so that prosecutions can be achieved if a person is found guilty of placing an animal in such a dangerous environment to cause any level of distress. This level of distress simply has to be considered by a reasonable person that the animal would not be in such distress should the animal not have been placed in that condition in the first place. Loophole closed as it would now a criminal offence and a prosecution would be possible. This would then hopefully act as a deterrent to ensure the animal is not placed in this dangerous condition in the first place, otherwise, the Police have a more defined set of legal parameters to prosecute by.
