Hospital Cameras and Patient Rights

The Issue

Cameras in healthcare are becoming more and more the norm. Whether they be from the patient perspective recording a provider or a hospital monitoring the patient in their private room. https://www.thehealthlawfirm.com/resources/health-law-articles-and-documents/Video-Surveillance-in-Patient-Care-Areas.html

There are many current legal gaps that must get on the radar before more problems arise. Hospitals and other facilities have even added recordings to medical records, which can be far out of reach to change or delete. To skip around HIPAA, powerful hospitals have added in their admittance agreement the condition that the patient will be monitored. The fine print. Imagine having to go to the hospital because you are sick and with that having to waive your rights to video privacy just to get allowed in.

This also includes the OR. Both Wisconsin and Korea have proposed bills that will legally require hospitals to record all surgeries.

There are many pros and cons to surveillance. Some wish they had it and have to resort to videoing with their phones whenever possible. Some cannot imagine an embarrassing procedure of us being filed away from our control.

Let lawmakers know that as the patient you have the right to receive care and opt out of being video monitored.
