The Issue

Dear Honorable Chief Minister of Tamil Nadu, Thiru Edappadi K. Palaniswami Avarkal,

Vanakkam!

The Tamil Nadu Government's cabinet under your leadership made a historical decision on September 9, 2018, in pursuant to the ruling of the Supreme Court of India,  to release all the seven persons -- Thiru Perarivaalan, Thiru Murugan, Thiru Santhan, Thiru Robert Pias, Thiru Jayachandran, Thiru Jeyakumar and Thirumathi Nalini -- who have been languishing in prison for 28 years in spite of completing their imprisonment period. Your government promptly sent its decision to the Governor of Tamil Nadu for necessary favorable action.  The inordinate and unduly long delay by the Governor who is yet to approve this recommendation by the Government of Tamil Nadu, which is duly elected by the people of Tamil Nadu, is totally and completely against the basic principle of democracy itself.

Thiru Thiagarajan, the police officer who investigated Perarivaalan has submitted an affidavit in the Supreme Court of India admitted that he failed to correctly record the statement by Perarivaalan and that Peraraivaalan is innocent.

Perarivaalan is in the dire requirement of getting immediate medical treatment, with no delay, due to various illnesses suffered by him as a result of his long imprisonment.  Perarivaalan's father, Thiru Gnanasekaran, who is 78 years old, is now undergoing treatment in a hospital due to a bone fracture suffered in an accident and he is unable to walk.   Perarivaalan's mother, Thirumathi Arputham Ammal, who is 72 years old is suffering from several illnesses due to old age.  Therefore, we request you, Sir, to take with you the leaders of all the political parties in Tamil Nadu and meet with the Governor of Tamil Nadu, and make every effort to immediately release Perarivaalan from prison by enlightening and impressing on the Governor with all the relevant and justified facts, in addition to bringing to his attention the Indian Supreme Court's unhappiness over his unduly long delay.

As this case is scheduled to be heard again in the Supreme Court on November 23, 2020, it is imperative to meet with the Governor now and impress on him so that Perarivaalan is released with no further delay. This will pave the way for the release of the remaining six Tamils who also have been languishing in prison for a very long period. Your steadfast efforts and the success of your endeavor will be gratefully acknowledged and recorded in the annals of the Tamil people's history.

Thanks,

Ravi Subramaniam
