Today the Federal Court has delivered an important victory for citizenship rights and procedural fairness. The Federal Court's decision in Hassouna v Minister of Citizenship and Immigration establishes that individuals have a RIGHT to a fair hearing when they are at risk of losing their citizenship under allegations of misrepresentation. That includes the right to know all the evidence against you, to have an oral hearing before an independent decision maker, and the consideration of humanitarian and compassionate grounds. The decision strikes down key provisions of the Citizenship Act that allowed for citizenship stripping without the right to a fair hearing. In her ruling, Madam Justice Jocelyn Gagné said, "once acquired, citizenship is a right." It is not a privilege that any government can give and take lightly. She continued, "the fundamental importance of the nature of the decision, specifically a determination of the Applicants' right to remain Canadian citizens, weighs in favour of a high degree of procedural fairness." The BCCLA has been fighting for the right to fair hearing for 15 months through our court challenge and in Parliament through Bill C-6. This decision makes it clear that Canadians have a right to a fair hearing. As the House of Commons prepares to receive Bill C-6 back from the Senate, we urge the government to swiftly pass legislation that complies with the court's decision, and restore the right to due process that Canadians had before Bill C-24.
