My Dear Friends, 

AMBIGUITY IN APPLICATION OF THE DIFFERENCE IN DEARNESS RELIEF RATE AS INFERRED BY THE HON'BLE SUPREME COURT IN THE CONTEMPT PETITION FILED BY SBM COMMUNE

At the outset,  I am of the opinion that the pre-existing status of the pensioners of the earstwhile SBM- an associate of SBI, doesn't undergo any change just merely as a consequence of the merger. The earlier benefits as envisaged in the pension regulations being a statutory provision, will continue to hold good and bound to be subsisting even as on the date.

The benefits thus accrued cannot be taken away at a later date -even after the merger.

At the same time implementing the above court order must not lead to another disparity among another section of the pensioners of equal footing. 

All it needs is that a workable solution is to be evolved to circumvent this problem.

Under the above circumstances, I only suggest that the IBA/SBI/ BANKS need to approach the HON'BLE SUPREME COURT explaining the conflicting situation and to put forth the following alternatives for the consideration of the court - ie:-

To extend 100% DA neutralization to the pre-2002 retirees  -OR-

To extend pension Updation to all the retirees as accorded our counter parts in RBI recently.

According to me, this seems to be a way out to dispell the existing anamoly/ambiguity. 

It's only my personal opinion within my limitted knowledge. However we need to consult our learned colleagues with legal expertise and that too after obtaining the court order in black and white.

FINALLY I TAKE THIS OPPORTUNITY TO ONCE AGAIN EXPRESS MY DEEP SENSE OF GRATITUDE � TO .... COM.C.N.PRASAD, GENERAL SECRETARY of SBI RETIREES ASSOCIATION FOR HIS COMMITMENT FOR OUR COMMON CAUSE.

The scratching remarks made by the Hon'ble Chief Justice of Karnataka -  Mr.. Justice Vikramjit sen are indeed worth noting.
