

Hold PepsiCo Accountable for Anti-LGBTQ+ Harassment and Retaliation
The Issue
For more than two years, a PepsiCo employee endured what she describes in a federal lawsuit as relentless anti-LGBTQ+ harassment on the job. Co-workers used homophobic slurs, told her they could not stand gay people, refused to share a restroom with her, demanded she use a deeper voice when speaking to men, and in one instance removed a safety vest in what she understood as a physical threat. She brought each incident to her direct manager, to human resources, and to the company's internal reporting hotline. According to her lawsuit, PepsiCo took no corrective action.
In November 2025, she took legally protected leave under the Family and Medical Leave Act to care for her husband. While on leave, PepsiCo informed her that a co-worker had accused her of workplace harassment. She denied the claim and says the company did not reinvestigate.
She came back to work in early December, completed her shifts without incident through December 29, and received a termination letter the following day for allegedly harassing a colleague. Her lawsuit, filed July 24 in federal court in Pennsylvania, calls the justification "false and pretextual" and charges PepsiCo with fostering a hostile work environment, sex discrimination under Title VII of the Civil Rights Act, and FMLA retaliation.
A 2020 Supreme Court decision, Bostock v. Clayton County, established that anti-LGBTQ+ workplace discrimination is sex discrimination under federal law. If the allegations are proven, PepsiCo violated that ruling while ignoring two years of internal complaints.
PepsiCo markets itself as a champion of workplace inclusion. The conduct described in this lawsuit is the opposite.
