Hold Medical Providers Accountable for Prenatal Negligence
The Issue
I lost my baby boy Koa due to prenatal negligence, and my heartache is unbearable. This tragic loss is a pain no parent should have to endure. I was a high risk patient being 40 y/o, IVF pregnancy & a sub chorionic hematoma. I requested a preventative cerclage from my OB due to my history & he denied it saying I did not need one. At 17 weeks I had an emergency cerclage done to stop dilation & close my cervix which can introduce bacteria (that was his first negligence) That procedure made my pregnancy even higher risk. My OBGYN whom I trusted did not treat me as a high risk patient. A few weeks after the procedure, on 12/26/24 I messaged my Dr about symptoms of a UTI. I requested a urine test be ordered. My request & concerns were ignored for an entire week. On 1/6/25 I went in for a visit & again informed my dr of my UTI symptoms, asked for a urine test, he said no urine test was necessary, did a vaginal exam & ordered bloodwork. My bloodwork results came in 2 days later with very high abnormal levels. I messaged him that day asking about my levels & if they were a concern, he never responded. 2 days later, I was experiencing severe pelvic pain & lower back pain & I knew something was wrong. I ended up in labor for over 30 hours, forced to deliver my precious son at 21 weeks, see his sweet beautiful face and feel him die on my chest over the course of an hour, feeling him slowly fade away. I then went septic, ended up in ICU needing 2 blood transfusions, dangerously low blood pressure, high fever & severe chills, clinging for my life because the infection from the UTI got into my entire body. We lost our miracle IVF baby boy who was so desperately wanted & prayed for & I almost lost my life simply due to my Drs negligence. After 8 years of trying to conceive & infertility, going through 2 Inseminations (IUI), getting pregnant after 2nd IUI & miscarrying at 8 weeks, 5 egg retrievals, & 2 embryo transfers (got pregnant with a boy after our 1st transfer but lost him, then miscarried again after losing this boy), we finally got pregnant with our miracle boy, only for him to be ripped away from us for something that was completely preventable had my Dr not ignored my symptoms. We are now going through our 8th egg retrieval hoping our son will come back to us in another life form.
Our healthcare system entrusts medical providers with the immense responsibility of ensuring the safety and well-being of both mother and child during pregnancy. When they fail in upholding their duty, it results in devastating consequences that ripple through families and communities.
Accountability in the healthcare system is crucial. We propose a set of actionable steps to reduce prenatal negligence and increase accountability. First, there should be mandatory reporting of all instances of prenatal medical negligence to a national database, which allows for systemic reviews and corrective measures.
Second, medical providers should undergo regular training and assessments on the latest prenatal care protocols to ensure they are equipped with the most current knowledge and skills. The standard of care expected for OBGYN Drs should also be re-evaluated & stricter higher level of care be given for UTI monitoring & treatment. Additionally, establishing a support system for parents affected by medical negligence will provide them with the resources and guidance they need to seek justice and support during such challenging times.
Lastly, prenatal negligence lawsuits should be easier to file against negligent providers holding them accountable. California specifically needs better medical negligence laws to protect the consumer. Currently the law is written to protect negligent medical providers, making it harder for victims like myself to seek justice.
