PETITION FOR ACTION BY BLACKTHORNE VILLA HOMEOWNERS

The Issue

We, the concerned residents of Blackthorne Villa, are calling for immediate action to hold KMC Management and the board members of our community accountable for their lack of response to homeowner concerns and complaints. Our community has been plagued by issues that have impacted our finances, health, safety, and personal/real estate properties.

Accounting/HOA Finances:

KMC Management and the board members have repeatedly demonstrated a lack of transparency in managing our finances, errors in recording HOA payments. Regular monthly financial statements have never been provided to the homeowners and the statements that are provided do not include the itemized billing (i.e. receipts and invoices to vendors are never attached).  Homeowners demand an itemized breakdown to be adequately  informed of where dues money is being spent.  There are concerns about charges in financials from 2022 and 2023 because the services no longer exist .  In 2021,  homeowners reported lost payments or uncredited payments.  As a result of these accounting errors and inaccurate information numerous letters were sent to homeowners regarding:

Charges for late fees 
Letters which threatened legal actions 
HOA reported inaccurate information to the credit bureau
Reimbursements were severely delayed to homeowners
Denial of voting rights in an important election for new board members.

Potential Health Issues/Diseases:


KMC management  and  Blackthorne Villas Board members' failure to address the following  concerns/complaints from homeowners is alarming because these conditions threaten the health and safety of our community, especially those residents with asthma, allergies, respiratory problems and compromised immune systems . Some of the reported complaints have included but are not limited to:

Standing water becoming contaminated
Drainage systems/lack of drainage systems
Mosquitoes/insects infesting the yards
Mold / fungus growth in yards/landscaping.  
As a result homeowners have attempted to resolve the potential health/ disease issues by hiring outside contractors to perform work or changing the landscaping in and around their homes.

 

Safety Concerns/ Issues:

Homeowners voiced  concerns regarding safety.  The safety issues have been but are  not limited to the following: 

Snow removal
Damage to sidewalks/ driveways placing people at risk when walking
Aggressive pets 
Inadequate lighting of our neighborhood, 
Again homeowners have had little or no response from KMC management and Blackthorne Villas Board members which endangers the safety of our community.

 Damage to Personal /Real Estate property:  

Numerous homeowners have reported damage to personal/real estate property because of the landscaping/mowing crew to KMC Management and Blackthorne Villas board and the owner of the landscaping/mowing crew. 

Concerns/complaints about the landscaping/mowing crew have included but are not limited to the following:

Mowing at high speeds 
Using the mowers rather than weed eaters
Mowing or weed eating and throwing grass into landscaped areas .
Many of the complaints regarding the damage to personal/real estate property still exist and they include but are not limited to:

Siding damage/brick damage
Mailbox damage
Sidewalk/driveway damage
Damage to actual landscape/yards (i.e. leaving ruts, mowing over plants, mowing when it is either too wet /too dry, and killing plants including shrubs)
Personal property on patios have also been damaged by the weed eating mowers, rocks, etc 
Because of the unaddressed damages caused by the landscaping/mowing crews, homeowners are demanding to have a discussion about a new landscaping /mowing crew be hired for our properties. 


Communication/Compliance Issues:

Effective communication between KMC Management and Blackthorne Board members with homeowners is crucial for maintaining a harmonious living environment. KMC Management and Blackthorne Villa's board members do not adequately inform homeowners and exclude them in the decision making process of our community. 

Many homeowners need written communication in the form of a letter.  However numerous homeowners have voiced their only communication comes in the form of  "compliance letters" that are accompanied with threatening/ aggressive language from KMC Management /Blackthorne Villas Board members..   Individual homeowners for many of the following issues but are not limited:  parking on public streets and homeowner driveways, temporary structures (i.e. tents for family functions and gated areas for pets), changes to landscaping due to not really having a landscape/mowing company which is alleged in the Blackthorne Villas HOA and financials). Homeowners have also received "compliance letters" for things that are well within their rights as homeowners.  Many of the alleged compliance violations have occurred because the health and safety issues were not been addressed by KMC Management or the Blackthorne Villa Board Members.

Although the KMC Connect platform exists and the intent to keep homeowners informed.  Having technology based communication is a barrier for many of the homeowners in our community because

Many homeowners were not aware of KMC connect platform 
Some do not have the technology required to access this website
Technology is a struggle for some
Disabilities affect some of our homeowners which interferes with their ability to understand certain types of communication
Finally, ignored concerns/complaints or lack of response from KMC management and Blackthorne Villa’s Board members have left numerous homeowners feeling they have no voice in their community and that KMC management /Blackthorne Villas Board members do not care about their concerns or complaints.

Call for Action

Blackthorne Villa homeowners are demanding immediate action from KMC management/Blackthorne Villa Board members and the Indiana HOA  authorities to investigate these matters thoroughly.  Our community deserves responsible leadership that will communicate and allow us to be informed and involved in the decision-making process regarding the  health, safety, finances, and overall well-being of our properties.
