Why this petition matters
New Mexico District Attorneys Office, Law Makers please hold intoxicated drivers accountable. Dismissal of vehicular homicide and DWI cases without prejudice in the state of New Mexico, by the district attorneys is a problem! I can name a couple cases within 1st District that were dismissed with clear evidence that a driver was intoxicated while committing vehicular homicide. We’ve read it time and time again in the newspapers. Case Dismissed! People loose their lives to intoxicated drivers, with out a trial of their peers they go on to continue living their lives and often repeating the offense. We need change and this matter is so very important to me because on June 27th, 2020 my step daughter was driving to a cabin with her girlfriend Felisha Barela to celebrate their birthdays. Just a day earlier Justice turned 23 years old, when an intoxicated driver struck their vehicle head on killing both of our June babies. Witnesses from both directions, toxicology reports all direct an evident that the drivers freedom should not be chosen by the District Attorney or her staff, but a jury of her peers. Justice Gutierrez Cruz left behind a son who was just 7 years old at the time of the accident. This petition is for him! Eduardo does not understand how a person who killed 2 innocent women can live their lives freely without a trial of their peers to determine the consequences for this person, who clearly broke the laws.
