Homeownership should be a path to stability—not a financial trap. Yet across Oregon, thousands of homeowners living in HOA communities are vulnerable to unpredictable, massive special assessments imposed by unregulated HOA boards. These assessments often fund vague or unnecessary repairs, with costs that cannot be independently verified or mathematically justified.
Under current Oregon law, HOA boards have sweeping authority with little to no oversight. The financial burdens harm the vulnerable owners the most: seniors, low-income families, and first-time buyers, forcing them into impossible situation. This is not just unfair; it’s unsustainable.
We, the undersigned, call on Oregon lawmakers to enact common-sense reforms that protect homeowners and restore balance to HOA governance:
✅ Owner Approval for Special Assessments
Require majority owner approval for any special assessment exceeding 5% of the annual budget.
Require 75% owner approval for any special assessment exceeding 15% of the annual budget.
✅ Contract Transparency
Mandate that all executed vendor contracts be posted in an owner-accessible documents portal to ensure transparency and prevent misuse of funds.
✅ Board Accountability
Require all board members to sign disclosure and transparency statements before serving, affirming their duty to act in the best interest of all homeowners.
✅ Fair Collection Practices
Cap collection and late fees at 10% of the owed balance.
Prohibit attorney involvement in collections, preventing minor fines from ballooning into thousands in legal fees. Associations already have lien rights—there’s no need to escalate and harm fellow owners.
✅ Independent Oversight
Establish a state-level oversight body to investigate HOA misconduct and enforce homeowner protections.
These reforms will help protect Oregon’s most vulnerable homeowners—especially seniors and low-income residents—and make HOA living a more stable, affordable option for all.
